Dear Ted Shepard,
. Ls you. are aware,, the owner of 860, g08, and 814'West Prospect was unable to finalize
an easement f omm the project to Lake Street as planned for, as shown on the project site
our discussion regarding the phone call you
plan and engineering docimtents. Following
received from Mike Smidke-of the Farm House Fratemity, I consulted with the project .
owner regarding our current options in light of this new situation-

Due to the fraternity's refusal to honor the -previous commitment with the; project owner
to grant an easement across their.property, we understand that the City Sty cannot
supportapproval fox the project at our scheduled hearing this >rvenit3g, September 14,
2004. We know that Prior to the Fraternities decision to back out of the Agreement, the
project was supported by City Staff, and.recommended for approval for tWs'evenings
hearing.
After discussion with -the project owner we would like to request a,contitivance for this
project per your advice.
Sincerely,
Donald IL Brookshire, ASLA
