Subject: Pakech, Pitt & NFCND&D Group Agreement
Mr. Shepard,
On the evening of June 14, 2006 Rob Dick, Kathy Crawford and I met with Ms. Pakech and Mr. Pitt
to better understand and resolve 3 issues that Ms. Pakech and Mr. Pitt held concerning the
development of the Arcadia neighborhood that is proposed to be directly north of the Pakech/Pitt
property. All three issues were addressed, resolved and agreed upon by all parties involved.
The first issue concerned the location of proposed lot 10 and its proximity to the Pakech/Pitt
residence and yard. The solution that both parties agreed upon was to move lot 10 from its current.
location to an alternative location on the development, while leaving the area where lot 10 was
currently shown, as revegetated slope and grading for stormwater conveyance. The second issue
concerned the stormwater runoff from approximately 5 acres of the development property entering
into the private storm system located at the northwest corner of the Pakech/Pitt property at Wood
Lane. The solution that both parties agreed upon was to create a pond area on the west end of the
development property, flowing into the development storm system where lot 10 used to be, capturing
all of the storm water conveyance and redirecting it to the east and south to the Soft Gold Park area.
Finally, along the northerly property line of the Pakech/Pitt residence directly adjacent to the house,
runs a makeshift swale that prevents nuisance and stormwater flows from hitting the structure located
directly south of the Pakech/Pitt north property line. Currently this swale, which fails to handle the
flow from the same 5 acres, mentioned previously, flows to the private storm system at Wood Lane
that was also mentioned previously. While the proposed pond solves the problem of the
overwhelming majority of the storm runoff, the current Swale will still receive nuisance flow from the
Pakech property and a minimal portion of the gradual slope from the Arcadia development. The
solution agreed upon by both parties was, to redesign that swale in such a manner that would direct
the subsequent flows to remain consistent with the current flow path.
With these issues identified and the above solutions agreed upon, all parties involved were satisfied
with the agreements and mutually affirmed that pending these three changes, there were no longer
any issues concerning the proposed Arcadia subdivision plan.
