All other changes to Building 3 represent reductions in the development bulk that bring the
project into closer conformance to the original Project Development Plan, prior to previous
amendments. The following drawings, with revisions described, have been submitted for this
Major Amendment

Changes are only proposed to Building 3 of the Project Development Plan. No changes are
proposed to the utility, landscape or drainage design of the project. The intent of this proposal is
that Building 3 will utilize the existing installed utilities. All site improvements to be constructed
concurrent with Building 3, including utilities, drainage and landscaping, shall comply with the
originally approved Final Compliance Documents for the Penny Flats Project Development Plan
and subsequent amendments. Considering that this proposed Major Amendment is for building
design modifications only and does not propose changes to the currently approved project
engineering we are formally requesting a waiver of the Transportation Development Review fee
for this application.

Statement of Planning Objectives: Penny Flats Subdivision, First Re -Plat, Lot 1A, City of
Fort Collins, Major Amendment to the Approved Project Development Plan
This proposed Major Amendment revises Building 3 of the previously approved Project
Development Plan from a 6 story building with a maximum height of 65' to a 4 story
building with a maximum height of 50'. In summary, the overall density and massing of the
project is proposed to be modified as follows:
• The previously approved number of residential units was 174. We are proposing an
INCREASE of 2 units for a total of 176 residential units.
• The previously approved total habitable floor area for the overall Project Development
Plan was 216,573 s.f. We are proposing a DECREASE of 4,711 s.f. for a total floor area
of 211,862 s.f.
• The previously approved total floor area of Building 3 was 21,313 s.f. We are proposing
a DECREASE of 4,711 s.f. for a total Building 3 floor area of 16,602 s.f.
• The previously approved total number of parldng spaces in the project was 312 spaces.
We are proposing an DECREASE of 7 spaces for a total of 305 spaces
Per the City of Fort Collins Land Use Code, Division 4.16 Downtown District (D), Section (B)
unit density for mixed use developments are approved through Type 1 review. We believe the
proposed INCREASE of 2 dwelling units to this development plan falls under this review criteria
and is consistent with the intent of the original approval.
Per the City of Fort Collins Land Use Code, Division 3.2.2 Access Circulation & Parking Section
(K)(1)(a) 1. "Multi -family dwellings and mixed -use dwellings within the Transit -Oriented
Development (TOD) Overlay Zone shall have no minimum parking requirements." Since this
project falls within this zone, we believe that the proposed DECREASE in off street parking is
appropriate given the project type and consistent with the Land Use Code
