commercial space in favor of dwelling units. This is due to the challenges of
filling commercial floor area one block west of North College Avenue and the
dearth of customers passing by the site. In other words, the site is not conducive
to ground floor retail or services.
The street -facing, first floor units, however, will be designated as "mixed -use
dwellings" in order to promote home occupations or live -work opportunities.
Further, these units will feature store -front architecture, double height street -
facing windows, and additional interior ceiling height so that should there a
reverse in market trends, conversion from residential back to commercial
remains feasible.
Part Three — Changes to Building Four — 2011
This Major Amendment affected Building Four only, located immediately north of
the existing building. As approved per the 2009 Major Amendment, Building
Four consisted of six stories, 26 dwelling units, 42 bedrooms and 3,000 square
feet of commercial space on the first floor. Per the 2011 Major Amendment, the
height was lowered to four stories, the number of dwelling units was increased to
30, the number of bedrooms was increased to 46 and the commercial space on
the first floor was eliminated. The first floor units, however, were specifically
designed for live -work capability.
There was no change to the below -grade parking. There was a reduction in
surface parking from ten to zero. Per the 2009 plan, the building contained a
total of 34,539 square feet. Per the 2011 plan, the floor area was reduced and
now contains 28,281 square feet.
The Major Amendment was approved such that any future conversion of the first
floor units back to commercial floor area could be processed as a Minor
Amendment.

Please provide Mayor Pro Tem Oh/son with a list of the revisions that were
recently approved (on the record) to the original development plan for the
Penny Flats Development.
To answer this SAR, the response needs to be divided into three parts. This is
because there have been two amendments since the original approval in 2007.
Part One describes the original approval. Part Two describes the changes
between the original approval and the First Major Amendment approved in 2009.
Part Three describes the changes between the First Major Amendment and the
Second Major Amendment approved in May of 2011.
Part One — Original Approval — 2007:
The overall site is 2.6 acres. The approved plan consists of eight buildings with a
mix of 147 residential units and 29,246 square feet of commercial space. The
development site does not include the Trolley Barn or its parcel, located in the
northwest quadrant of the site. The existing structure is referred to as Building
Five. In addition, the underground parking was fully constructed to serve the
existing building plus future Buildings Three and Four.
2. Part Two — Changes to Buildings Three and Four - 2009:
The first Major Amendment affected only future Buildings Three and Four which
are located directly north of Building Five. Building Three would front on the
internal Civic Center Spine and Building Four would front directly onto Mason
Street. The changes are summarized as follows:
• The amendment approved an increase in the total number of dwelling
units from 147 to 170 for a gain of 23 units. For the overall project, this
represented a 15.6% increase.
• The amendment approved an increase in the total floor area of the overall
project from 200,838 square feet to 222,831 square feet for a gain of
21,993 square feet. This represents an 11% increase.
• The amendment approved a decrease in the overall commercial floor area
from 29,246 square feet to 25,400 square feet for a loss of 3,846 square
feet. This represents a 13% decrease. Note that 2,592 square feet was
located on the second floor.
• The amendment approved an increase in the number of parking spaces
from 317 to 323 for a gain of six spaces.
• The amendment approved an increase in the height of Buildings Three
and Four from four stories to six stories for gain of two stories.
