The proposed sidewalk connection does not meet the standard, more connections along the north and east sided of the property to the public right of way are needed. The route selected is the only route that will meet ADA. The site sits in a substantial hole and 3:1 slopes exist along the entire east frontage. We explored another connection along the northerly Frontage Road, but that route did not meet ADA either. Stairs are not acceptable due to liability issues. Since the original plat established building envelopes and setbacks the proposed building should be brought to the north and east building envelope line. The building is currently placed at the 25' setback on the east side. Since detention and water quality are required for this site, there is insufficient room to move the building to the north setback line. We feel the pedestrian patio on the north is a greater amenity than moving the building north. Our reading of the code is that the parking lot setback is 5' minimum and 10' average. We have set the setback at 10' at the midpoint of the stall which should meet the 10' average requirement. LUC 3.2.1(E) 6% of the interior parking lot is required to be landscaped. We have added a landscape island in the parking row along the west property line. This only brings the interior landscape to about 2.6%. We are providing 46% total landscape area on the site. Subway cannot lose any more parking spaces and remain a viable project. Without a replat, this process will need to be done by separate document using the City's Transportation Development Review Fee form (TDRF). An effort to put more landscaping at the building entrance and building face should be investigated. Perhaps the eastern 25' building setback along the frontage road could be reduced. The LUC code may allow a 15' - 25' building setback range. At a minimum, a shade tree should be placed in a cut-out or tree grate directly south of the HC parking space. A proposed tree south of the building can be relocated to meet this requirement. Refer to redline plan. Again, the narrow site is the constraining factor. We have added a tree grate as suggested above. The purpose of this letter is to outline issues that we will not be able to address, and provide explanation why. We would like to resolve these differences prior to making the full re -submittal in an effort to avoid future reviews. I have added text in red below to discuss said issues. Due to the narrow nature of the site and 25' required setback to the east, we have provided the maximum sidewalk possible. Note that the required sidewalk for ADA is 3' which we exceed.
