Aerial Map 4 Poudre School District — Cooper Home, Site Plan Advisory Review #SPA120003 June 21, 2012 P & Z Hearing Under Section 31-23-209, C.R.S., the Planning and Zoning Board should make a finding as to the location, character, and extent of the public building relative to the adopted Master Plan (City Plan) of the City. Such findings help ensure that the proposed project conforms to the adopted plan of the City of Fort Collins. 4. . Medium Density Mixed -Use Neighborhood (MMN) District (Section 4.6): Public and private schools, including colleges, universities, vocational and technical training are permitted in the MMN district, subject to administrative review (Type 1). The MMN Land Use (4.6(D) and Development (4.6(E) Standards are not applicable to this proposal as they are not altering the existing single-family house in which the Cooper Home (school) use is proposed. 5. Compliance with Applicable General Development Standards: Section 3.2.2(K) - Parking The existing house has two driveways with capacity for three vehicles. The parking standard for Schools, Places of Worship or Assembly and Child Care Centers (Sec. 3.2.2(K)(h) requires two parking spaces per three employees (0.67/employee). With four staff members three parking spaces are required and are being provided. 6. Neighborhood Meeting: The neighborhood informational meeting was held on May 29, 2012. The discussion was focused on understanding the impacts of the use. When explained that the students would only be there during the day on regularly scheduled school days and the property would be maintained during the summer, all neighbors who attended the meeting were in support of the Cooper Home being located at 217 East Swallow Road. 7. Findings of Fact and Conclusion: In reviewing the request for the Poudre School District, Cooper Home, Site Plan Advisory Review, staff makes the following findings of fact: A. The Site Plan Advisory Review complies with State Statute Section 31-23- 209, C.R.S., in that the location, character, and extent of the proposed new use and associated site improvements conform to the adopted Master Plan (City Plan) of the City of Fort Collins. B. The Site Plan Advisory Review complies with the applicable General Development Standards of Article Three and the zone district standards of Article Four. 3 Poudre School District —Cooper Home, Site Plan Advisory Review #SPA120003 June 21, 2012 P & Z Hearing EXECUTIVE SUMMARY: Since Poudre School District is a political subdivision of the State, the project is governed by the Site Plan Advisory Review process in accordance with the pertinent State Statutes. The project's location, character and extent are found to be in compliance with the City's comprehensive plan. COMMENTS: 1. Background: The surrounding zoning and land uses are as follows: N: Low Density Residential (RL) — Single-family residences S: General Commercial (CG) — Foothills Mall E: Medium Density Mixed -Use Neighborhood (MMN) — Single-family & Mixed -Use W: General Commercial (CG) — College Avenue commercial 2. Zoning History: The subject property was platted as the Thunderbird Estates Eighth Subdivision in the City of Fort Collins in 1970. The house was constructed in 1970. 3. Right of Advisory Review: Colorado Revised Statutes provides two specific references which allow the City to review the planning and location of public facilities: A. Section 22-32-124, C.R.S., as amended, addresses the right of the Poudre School District to construct facilities within a municipality and decide the location or manner of construction of such schools. The statutes specifically limit municipalities' participation in the process to a limited right of review and appeal to the Poudre School Board. B. Section 31-23-209, C.R.S. provides that no public building shall be constructed or authorized in a city until the "location, character and extent thereof' has been submitted for approval by the Planning and Zoning Board. In the case of disapproval, the Planning and Zoning Board shall communicate its findings to the Poudre School Board. The disapproval of the Planning and Zoning Board may be overruled by the Poudre School Board by a vote of not less than two-thirds of its membership. 4 �of t Collins I i EM NO MEETING DATE b ,L4 Ii- STAFF %r-'5v PLANNING & ZONING BOARD PROJECT: Poudre School District — Cooper Home, 217 East Swallow Road, Site Plan Advisory Review #SPA120003 APPLICANT: Poudre School District c/o Brad Knutson 2445 Laporte Avenue Fort Collins, CO 80521 OWNER: Bonnie Wingate 217 E. Swallow Fort Collins, CO 80525 PROJECT DESCRIPTION: This request is to locate the Poudre School District's Cooper Home in a 1,416 square foot single-family house on a 0.21 acre lot at 217 East Swallow Road. The Cooper Home is a facility to assist disabled students, 18 — 21 years in age, in transitioning into their next phase in life. It will serve 15 — 22 students during the regular school day and year. This facility will not be used for over -night accommodation. The only physical changes proposed to the property are the paving of an existing driveway and alterations to the sidewalk and house entry in order to be compliant with the American with Disabilities Act (ADA).
