HomeMy WebLinkAboutTHE DISTRICT @ CAMPUS WEST PDP - APPEAL OF H.O. DECISION - PDP120003 - CORRESPONDENCE - CORRESPONDENCE-HEARING (5)Page 4 of 4 1. A condition was offered at the Type 1 hearing in connection with Building 2 (the garage), but was not made a condition by the Hearing Officer. The offer was to slope the roof on the north facade of that building from its tallest point of 48 feet in height on its east corner to a height of 37 feet, 6 inches on its west corner. I believe there was a slide of this at both the Type 1 and the appeal hearings. 2. At the Type 1 hearing, the roof of Building 1 was already shown on the PDP as stepping down from 5 stories to 4 stories on its north side. However, another condition was offered in connection with this building: that the roof be pitched, but again the HO did not make that a condition. Two new conditions were agreed to at the appeal hearing in connection with Building Three: stepping down from 5 to 4 stories the same as was shown for Building One and pitching the roof. Linda Ripley has suggested that the language for both Buildings 1 and 3 be as follows: "That the north thirty (30) feet of Buildings One and Three, as shown in the PDP for Building One, must be reduced in height from five (5) to four (4) stories, and that the fourth story must feature a pitched roof, so as to reduce the building height along the north elevation of these buildings." Note that we don't think the term "on the perimeter of the PDP site" should be used as it's too vague. Let me know if we need to talk further about these. Lucia 8/21/2012 Page 3 of 4 Would you please email me the final condition language before the meeting tonight? Thanks. Liley Subject: RE: District Conditions Lucia, Here's the version of the appeal conditions that is going into the packet (please let me know if there is a problem with this version from the Applicant's standpoint): That, in order to mitigate impacts and reduce the adverse light and shadow impacts from the buildings to be constructed, the approval of the PDP is hereby conditioned upon the following additional conditions: a. That each of the three (3) residential buildings comprising the PDP must be certified at the Silver level using the Leadership in Energy and Environmental Design ("LEED") for Homes 2008 rating system ("LEED Silver"). b. That the north side of Building Three, as designated in the PDP, must be reduced in height from five (5) to four (4) stories in the same manner and to the same extent as shown for Building One on the approved PDP plans, and that the fourth story roof of Building One and Building Three must each be pitched so as to reduce the building height along the north elevation of these buildings . C. That all new trees along the entire north perimeter property line of the PDP must meet or exceed the minimum tree size specifications described in Land Use Code Section 3.2.1(D)(4), and instead meet the higher tree size requirements of Land Use Code Section 3.2.1(F)(1). —C Carrie Mineart Daggett Deputy City Attorney Fort Collins City Attorney's Office 300 La Porte Avenue Fort Collins, CO 80521 (ofc) 970-416-2463 (cell) 970-219-6426 (fax) 970-221-6327 From: Lucia A. Liley' Cc: Ted Shepard Subject: RE: District Conditions Lucia, We had been discussing it and after going back through the Council hearing video stream for the nth time, I found some references made by Ben to the garage in connection with the conditions he was proposing. So, here is the version that is going (this one is the final): 5. That, in order to mitigate impacts and reduce the adverse light and shadow impacts from the buildings to be constructed, the approval of the PDP is hereby conditioned upon the following additional conditions: a. That each of the three (3) residential buildings comprising the PDP must be certified at the Silver level using the Leadership in Energy and Environmental Design ("LEED") for Homes 2008 rating system ("LEED Silver"). b. That the north side of Building Three, as designated in the PDP, must be reduced in height from five (5) to four (4) stories and that the fout tit story intist fcatme a pitched reef-, so as to redtiee the building height at the pet imeter of the PEW site in the same manner and to the same extent as shown for Building One on the approved PDP plans, and that the fourth story roof of Building One and Building Three must each'be pitched so as to reduce the building height along the north elevation of those buildings. C. That Building Two as designated on the approved PDP, must be designed and constructed so that the roof along the north facade of that building sloges down from its tallest point of 48 feet on its northeast corner to a height of 37 'h feet at its northwest corner. d. That all new trees along the entire north perimeter property line of the PDP must meet or exceed the minimum tree size specificatioyS esc in Land Use Code Section 3.2.1(D)(4) and instead meet thel ".-.'tree size requirements of Land Use Code Section 3.2.1(F)(1). I think this covers the issues that had been identified; please let me know if that's not correct from your standpoint. Thanks! i11 -C . V Carrie Mineart Daggett Deputy City Attorney Fort Collins City Attorney's Office 300 La Porte Avenue Fort Collins, CO 80521 (ofc) 970-416-2463 (cell) 970-219-6426 (fax) 970-221-6327 1vv U n From: Lucia A.
