DEVELOPMENT AGREEMENT FOR KECHTER CROSSING PLANNED LAND
DIVISION _ FILE #06-S2583
This Agreement is made this day of September, 2012 between the Board of
County Commissioners of Larimer County, Colorado ('.'County'); 2309 Kechter LLC
("Developer"); and Kechter Crossing Homeowners Association, Inc. ("Association"); and
City of Fort Collins, Colorado ("City").
WHEREAS, Developer is the owner of certain real property situated in Larimer
County, Colorado, described on Exhibit A attached hereto and incorporated herein
("Property,);
WHEREAS, County has. approved the Preliminary Plat of the Kechter Crossing
Planried Land Division by Findings and Resolution dated February 12, 2008 and recorded
February 15, 2008 at Reception No. 20080009502 of the Larimer County records; and
WHEREAS, Developer has submitted to County for approval, execution and
recordation a Final Plat for Kechter Crossing Planned Land Division; and
WHEREAS, Developer intends to develop the Property in a'single phase using a
defined set of improvements; and
WHEREAS, County has considered the Final Plat, the proposed development and
improvements to the Property, and the requirements to be imposed upon the Property by
reason of the proposed development and improvement of the Property included in the
Final Plat; and
WHEREAS, County is willing to approve, execute and accept for recordation the
final plat upon the agreement of Developer and Association to the matters described in
this Agreement; and I '
WHEREAS, County and Developer mutually acknowledge the existence of and
support the principles. and intent set forth in the Fossil. Creek Reservoir Area. Plan
adopted by the City of Fort Collins City Council on March 17, 1998, and by the Larimer
County "Plaming Commission on. March 25, 1998; and in the Intergovernmental
Agreement for the Fort Collins Urban Growth Area, adopted on November 21, 2000, by
both the Chairman of the Larimer County Board of Commissioners and the Mayor of the
City of Fort Collins; and
