and Sage Creek Road is at two thousand (2000) feet such that the extension of County Fair
Lane onto Ziegler Road in between is needed to meet this code criterion. The extension of
County Fair Lane onto Ziegler Road has always been anticipated with the development of your
Harvest Park subdivision. If you have any questions on this portion of our Land Use Code,

Regarding the potential traffic concerns associated with this extension, the City Traffic
Operation's department monitors the City roadways and intersections for quality of service,
safety and other aspects, but also works with neighborhoods experiencing undesirable traffic
characteristics. If you have concerns on your neighborhood streets currently or in the future
please contact Traffic Operation's Neighborhood Traffic Management Program at 970.221.6630.
Regarding your concern related to a gas station/convenience store being proposed on the north
parcel, this type of use is allowed in the Low Density Mixed -Use Neighborhood Zone District.
However, at this time, these land uses are only approved at the conceptual level through the
approval of the project's ODP and the applicants have left open the opportunity to either provide
commercial or residential land uses at this site. A PDP, which formally establishes a site's lands
uses, would still be required. If commercial uses were proposed that include a gas station, then
the PDP would be subject to Planning and Zoning Board review. However, I have noted your
concerns and will store them in the project file. Should a PDP be submitted for the northern
parcel, then we would ask that the applicant address your concerns at that time.
Regarding the use of the name Harvest Park/Ziegler, I am not aware of any City regulation that
dictates what a project can be named. However, I would encourage you to contact the
applicant/developer directly to discuss these concerns with him. His name is Steve Steinbicker,

Dear Mr. Potter,
Thank you for sending on your letter regarding the Harvest Park/Ziegler Overall Development
Plan project. I'm happy to respond to your questions and comments, and I've coordinated with
other staff members to address your concerns related to street connections and traffic.
In your letter, you indicated that the Planning and Zoning Board did not conduct a hearing on
this topic during their April 18, 2013 meeting. As you may have observed, this item was heard
during the Consent portion of the Board's agenda and was passed unanimously. As with all
consent items, there is an opportunity to "pull" the item from the Consent Agenda and have it
placed on the Discussion Agenda. I'm sorry I did not know you were in the audience, as I met
with several neighbors of the project both prior to and after the Hearing to discuss both the
hearing process and more details about the project. If you would like to access the details of the
project that were provided to the Planning and Zoning Board, there are available via this
website: http://www.fcgov.com/cityclerk/planninq-zoning.php. If you click on the link that says
"download agenda" next to the April 18, 2013 meeting date, then you can download all of the
materials provided to the Board.
I should note the item the Board approved related to this project was the Overall Development
Plan (ODP), which establishes general planning and development control parameters for
projects that are developed in phases. In other words, the ODP established the different land
uses, e.g., multi -family to the south of County Fair Lane and either a Neighborhood Commercial
Center (that could include a gas station/convenience store, as per your letter) or additional
multi -family development.
At this time, only the southern portion of the property has been submitted at the Project
Development Plan (PDP) level, which is where more details about the project are established.
The submitted PDP for the southern lot includes 22 multi -family units. A hearing has yet to be
scheduled for the PDP, but you will receive a notice for that hearing as well. Because of the type
of project and the zoning, , the PDP will be reviewed by an Administrative Hearing officer,
instead of by the Planning and Zoning Board At the Administrative Hearing , you will have the
opportunity to testify about the project and ask questions during the PDP hearing. You may also
submit comments in advance (such as those in your April 19 letter). Comments received in
advance will be'considered during the review process and provided to the Administrative
Hearing officer with other documents for the hearing.
Regarding your concern about extending County Fair Lane onto Ziegler Road, this extension is
a requirement by.the City in accordance with Section 3.6.3(C) of the Land Use Code, which
requires that local streets intersect with arterial streets at intervals not to exceed one thousand
