I didn't get the drawings, but it certainly sounds like the City will need to grant them a slope easement and if they need
more space to construct the slope, we will also need to grant a construction easement. I'm not sure on the maintenance
agreement — will you be asking the developer to do all maintenance on the slope easement, or just maintenance to
maintain the slope. If it is just to maintain slope, that could be part of the slope easement. It would be good to look at
this with you to confirm we have all interests needed. But at first blush — Craig you did good!!!

1 believe we will need to grant the construction easement, slope easement?; and long term maintenance easement to the

Craig,
We are planning to submit a revision to the Hickory Commons PDP this week, and we have a comment from Andrew
Gingrich in Development Review Engineering that we need to seek an easement or agreement from Park Planning.
Please see the attached drawings. If you recall, Hickory Commons PDP is immediately adjacent to the Hickory spur of
the Poudre River Trail, and we are grading up to the property line, and tying in to the trail in a few spots. This may
constitute the need for a slope easement and an access easement, but I'm not sure. It is my understanding that Andrew
wants us to find out from you what sort of easement or agreement you would want for that. Can you let me know?

Off Site Easements
Prior to the scheduling of a public hearing, we will continue the attached conversation with Helen
Matson and Craig Forman to get the necessary easement on the adjacent city -owner trail property.
