request for release of project funds will not significantly affect the quality of the
human environment and hence, an Environmental Impact Statement will not
be undertaken under the National Environmental Policy Act of 1969 (P.L. 91-
910). The reasons for the decision not to prepare an Environmental Impact
Statement are as follows: The project will not significantly affect the quality of
the human environment.
PUBLIC COMMENTS ON FINDING
All interested agencies, groups or persons disagreeing with these decisions are
invited to submit written comments for consideration by the City of Fort Collins
by August 23, 2011. All comments must clearly specify which decision they
object to in the Finding of No Significant Impact or the Request for Release of
Funds. All comments so received will be considered by the City of Fort Collins
prior to its taking any administrative action or requesting release of funds on
the date listed immediately above.
RELEASE OF GRANT FUNDS
The City of Fort Collins will undertake the project described above with
Community Development Block Grant (CDBG) funds under Title I of the
Housing and Community Development Act of 1974, Public Law 93-383 and
HOME Investment Partnership Funds from the U.S. Department of Housing
and Urban Development (HUD) under Title II of the Cranston -Gonzales
National Affordable Housing Act. The City of Fort Collins is certifying to HUD
that the City of Fort Collins and Darin A. Atteberry, City Manager, in his official
capacity, consent to accept the jurisdiction of the Federal courts if an action is
brought to enforce responsibilities in relation to environmental reviews,
decision making, and action; and that these responsibilities have been
satisfied. The legal effect of the certification is that upon its approval, the City
of Fort Collins may use the CDBG and HOME funds, and HUD will have
satisfied its responsibilities under the National Environmental Policy Act of
1969 and other environmental responsibilities listed in 24 CFR Part 58. HUD
will accept an objection to its approval of the release of funds and acceptance of
the certification only if it is on one of the following bases: (a) that the
certification was not in fact executed by the Chief Executive Officer or other
officer of the City of Fort Collins and (b) that the City, of Fort Collins
Environmental Review Record for the project indicated omission of a required
decision finding or step applicable to the project in the environmental review
process, or (c) another Federal agency has submitted written comments
pursuant to Section 309 of the Clear Air Act or Section 102(c) of NEPA.
Objections must be prepared and submitted in accordance with the required
procedure (24CFR Part 58), and may be addressed to: David W. Rigirozzi, Field
Environmental Officer, U.S. Department of Housing and Urban Development
(HUD), Region VIII, 25th Floor, 8ADE, 1670 Broadway Street, Denver CO

Notice of Finding of No Significant Impact (FONSI)
Dear Steve:
The above -referenced project is requesting federal funds from the Community
Development Block Grant (CDBG) and HOME Investment Partnership Programs
through the U.S. Department of Housing and Urban Development (HUD). The City of
Fort Collins is the Responsible Entity (RE) for the CDBG and HOME Investment
Partnership Program funding. The RE must authorize the performance of a federal
Environmental Review in accordance with the National Environmental Policy Act of
1969 (NEPA). If the Responsible Entity makes a Finding of No Significant Impact
(FONSI), it must prepare a FONSI notice and send the notice to interested parties under
24 CFR Part 58: Section 58.43.
