SUMMARY OF CONCLUSIONS
A. The Replat of Tract 'W' of the Waterglen Planned Unit Development Project
Development Plan is subject to administrative review and the requirements of the
Land Use Code (LUC).
B. The Replat of Tract W' of the Waterglen Planned Unit Development Project
Development Plan satisfies the development standards of the I zoning district.
C. The Replat of Tract 'W' of the Waterglen Planned Unit Development Project
Development Plan complies with all applicable General Development Standards
contained in Article 3 of the Land Use Code.
DECISION
The Replat of Tract 'W' of the Waterglen Planned Unit Development Project
Development Plan #71-93D, is hereby approved by the Hearing Officer without
condition.
Dated this 3rd day of February 2003, per authority granted by Sections
1.4.9(E) and 2.1 of the Land Use Code.

FACTS AND FINDINGS
The surrounding zoning and land uses are as follows:
N: E; vacant, undeveloped land
S: LMN; existing single family residential (Waterglen PUD)
W: LMN; existing single family residential (Waterglen PUD)
E: I; existing interstate highway (1-25) and industrial use
This property was annexed into the City as the Vine Business Park Annexation in
October, 1987.
The subject property was originally platted as Tract 'W' of the Waterglen PUD final
development plan that was approved by the Planning and Zoning Board in October,
1994 for a self -storage facility on approximately 4 acres.
1. Compliance with Article 4 and the LMN Zoning District Standards:
The Project Development Plan complies with all applicable requirements of
Article 4 and the LMN Zoning District. The Staff Report summarizes the PDP's
compliance with these specific standards and no specific evidence was
presented to contradict the statements and conclusion of the staff report
concerning compliance with Article 4 or the I District Standards.
2. Compliance with Article 3 of the Land Use Code — General Development
Standards
The Project Development Plan complies with all applicable requirements of
Article 3 including all landscaping and screening, and public improvements. No
evidence was presented to contradict the statements and conclusion of the staff
report concerning compliance or to other refute the compliance with Article 3.
While there was no direct testimony or evidence presented at the public hearing
to contradict the Project's compliance with these standards, testimony was
provided by two attending neighbors who raised questions about the inclusion of
storage as an approved use on the site, and the impact to utility corridors and
drainage resulting from the replat. Both the applicant and the staff presented
information on the history of the previously approved Planned Unit Development
that established the right of the owner to build a storage facility on this parcel. At
the hearing, the applicant's civil engineer reviewed the location of existing and
proposed water and sewer mains and service lines, and how these facilities
comply with the City's utility standards.

NOTICE OF PUBLIC HEARING: Evidence presented to the Hearing Officer established
no controversy or facts to refute that the hearing was
properly posted, legal notices mailed and notice
published.
The Hearing Officer, presiding pursuant to the Fort Collins Land Use Code, opened the
hearing at approximately 5:00 p.m. on January 22, 2003 in Conference Rooms C&D at
281 North College Avenue, Fort Collins, Colorado.
HEARING TESTIMONY, WRITTEN COMMENTS AND OTHER EVIDENCE:
The Hearing Officer accepted during the hearing the following evidence: (1) Planning
Department Staff Report; (2) application, plans, maps and other supporting documents
submitted by the applicant and the applicant's representatives to the City of Fort Collins;
(3) a sign up sheet of persons attending the hearing; and (4) a tape recording of
testimony provided the hearing. The LUC, the City's Comprehensive Plan (City Plan),
and the formally promulgated policies of the City are all considered part of the evidence
considered by the Hearing Officer.

This is a request to replat Tract'W' of the Waterglen PUD, being the previously
approved Waterglen Self -Storage site. The property is 3.4 acres in size and is on the
east side of Waterglen Drive, north of East vine Drive, and west of Interstate 25.
