requirements located in Section 3.3.1 - Plat Standards located in Article 3

being public streets. Condo Block 2 has direct vehicular access to
Autumn Ridge Drive, Rose Creek Way, and Desert Willow Way, being
public streets. Condo Block 3 has direct vehicular access to Desert
Willow Way and Crown Ridge Lane, being public streets.
2) The general layout of lots, roads, driveways, utilities, drainage facilities
and other services on the property have been previously established
with the Provincetowne PUD, Filing No. 2 development plan.
C. The subdivision plat is in compliance with Section 3.3.1(C) Public Sites,
Reservations and Dedications in that:
1) An applicant shall be required to dedicate rights -of way (ROW) for
public streets, drainage easements and utility easements as needed to
sere the area being platted. The ROW for East Trilby Road, the
public arterial street adjacent to this development, was previously
dedicated in Larimer County. The drainage and utility easements
necessary to sere these condo blocks and multi -family dwelling units
will be dedicated with the Provincetowne PUD, Filing No. 2, First
Replat subdivision plat, if approved and filed.
2) Reservation of sites for flood control, open space and other municipal
uses shall be made in accordance with the requirements of this Land
Use Code, and generally, the City Code.
5. Findings of Fact/Conclusion:
A. The Provincetowne PUD, Filing No. 2, First Replat contains a permitted
use in the LMN — Low Density Mixed -use Neighborhood Zoning District.
B. The Provincetowne PUD, Filing No. 2, First Replat meets the procedural
requirements located in Division 2.1 - General Procedural Requirements,
Division 2.2 - Common Development Review Procedures for Development
Applications, and Section 2.4 - Project Development Plan located in
Article 2 - Administration.

3. Article 2 - Administration:
The Replat of Condo Blocks 1 - 3, Provincetowne PUD, Filing No. 2 complies
with the applicable requirements of the Luc, specifically the procedural
requirements located in Division 2.1 - General Procedural Requirements,
Division 2.2 - Common Development Review Procedures for Development
Applications, and Section 2.4 - Project Development Plan located in Article 2 -
Administration.
4. Article 3 - General Development Standards:
The Replat of Condo Blocks 1 - 3, Provincetowne PUD, Filing No. 2 complies
with the applicable requirements of the Luc, specifically the plat requirements
located in Section 3.3.1 - Plat Standards located in Article 3 - General
Development Standards.
A. The subdivision plat is in compliance with Section 3.3.1(A) General
Provisions in that:
1) The subdivision plat will be filed and recorded only after having been
approved by the Director of Planning, with such approval evidenced in
writing on the plat and signed by the City Clerk.
2) Except with respect to property which is platted as an official
subdivision (or part thereof), no building permit or certificate of
occupancy shall be issued for construction of any new principal
building or no act which changes the use of any building shall be
permitted until the subdivision plat is filed and recorded in the City of
Fort Collins.
B. The subdivision plat is in compliance with Section 3.3.1(B) Lots in that:
1) Condo Blocks 1 - 3 contain building envelopes and access, utility, &
drainage easements for multi -family dwelling units. There is no
minimum lot size requirement in the LMN District. Condo Block 1 has
direct vehicular access to Autumn Ridge Drive and Rose Creek Way,

COMMENTS:
1. Background:
The surrounding zoning and land uses are as follows:
N: E; existing City of Fort Collins Transfort Facility
S: LMN; existing single family residential (Provincetowne PUD, Filing 2)
W: R2, FA-1 in Larimer County; undeveloped
E: LMN; existing single family residential (Provincetowne PUD, Filing 2)
This property was annexed into the City as part of the Halcyon Annexation in
December, 1980.
The subject property was originally subdivided as Condo Blocks 1 - 3, the multi-
family portion of the Provincetowne PUD, Filing No. 2 final plan that was
approved by the Planning and Zoning Board in January, 2001 for 141 residential
dwelling units on 14 acres.
2. Purpose of the Subdivision:
The primary purpose for the replatting of Condo Blocks 1 - 3, Provincetowne
PUD, Filing No. 2, is to vacate utility, drainage and access easements, as
necessary, to accommodate porch stoops and building overhangs in numerous
locations. The replat will not increase or decrease the number of dwelling units in
this development. The replat will provide for 34 building envelopes (to contain
141 dwelling units).
Staff has determined that there is no detriment to the development plan
associated with the replatting of the property.

PROJECT DESCRIPTION:
This is a request to replat Condo Blocks 1 - 3, the multi -family portion of the
Provincetowne PUD, Filing No. 2, for the primary purpose of vacating utility,
drainage and access easements, as necessary, to accommodate porch stoops
and building overhangs in numerous locations. The property is at the southwest
corner of Trilby Road and Autumn Ridge Drive and is in the LMN — Low Density
Mixed Use Neighborhood Zoning District.
RECOMMENDATION: Approval
EXECUTIVE SUMMARY:
This is a request to replat Condo Blocks 1 - 3, Provincetowne PUD, Filing No. 2,
