As to the "build -to" line requirement set forth in Section 3.5.3(B)(2) of the LUC, if this requirement is not being met then the applicant must request a modification to the standard based on the criteria set forth in Section 2.8.2(H) of the LUC. The placement of Building C does not meet the "letter of the law" in Sec. 3.5.3(B)(2); therefore, you must submit a request for a modification. Yes, you could include the request in the "Justifications for Variances from Criteria" section of your Statement of Planning Objectives, clearly spelling out what section of the LUC you are requesting a variance to [3.5.3(B)(2)]and the section of the LUC you are basing your justification on [2.8.2(H)]. The existing street trees along the park look very healthy. Therefore we decided not to change them. However, we are going to provide street trees wherever there are none existing along Mason Court. We will follow the min.40' spacing except for where the storm water easement does not allow us to do so. As for the "built -to" line requirement, what is a "modification request"? Is it something I can include in our "statement of planning objectives" report (there is a section in that report titled "justifications for variances from criteria") or does it need to be a separate document?
