HomeMy WebLinkAboutMASON STREET NORTH - MAJOR AMENDMENT - 4-97B - CORRESPONDENCE - (10)January 18, 2002 City Planning and Zoning Advisory Board, Jerry Gavaldon, Chairman City of Fort Collins, Council Fort Collins, CO 80521 RE: Discussion at the City Planning Meeting 1/17/02 The City staff and planning committee showed much positive interest in Lot 12 development to enhance the downtown and future City buildings across Cherry Street. The design and planning seem first rate and I look forward to watching it develop. 10 I a10 ppreciated everyone recognizing the liability and maintenance expense 10 lot owners were being asked to shoulder for half of the block; River Rock Co -housing 34 units the other half. The narrow street slows traffic, but could be used quite a bit by baseball families who cannot fit into the lower parking lot coming through Mason Court from Sherwood to the upper parking spaces of Mason Street North. This private street with public access is a special case. According to planners, a private road can serve a maximum of four houses. Municipalities cannot be sued, but corporations and individuals can. A legal judgment resulting from an automobile or other accident on our street could be catastrophic for individual families. This superior development deserves special treatment from the City because it has already upgraded and enhanced the downtown area. Jerry Galvadon referred to the "shared responsibility" mentioned by the developers. I asked Mickey Willis, one of the developers who proposed an "umbrella responsibility solution' to put in writing his proposal for handling the insurance and maintenance liability. As soon as I have that information, I will share it with our HOA, the City Planning & Zoning Committee, and the City of Fort Collins. I want to thank Steve Olt and Katie Moore for coming to the site on short notice to share the planning thoughts with me and Rick Richter who met to give me some idea of Street Maintenance costs the 10 lots are to be budgeting for future maintenance and replacement.
