Stormwaters concerns: * They don't have adequate detention - Stormwater feels that they may have entered the wrong rainfall amounts into the model. * They have done nothing to address water quality from the site. Per the LUC they are required to provide some type of water quality using best management practices. Engineering/Transportation concerns: * Per the LUC (Sections 3.2.2(C)(6), 3.6.5(A) and 3.6.5(B) ) and the Transit Design Standards and Guidelines items # 2 and 7 (referenced in the code sections) the applicant shall provide an access easement for a pedestrian/ bicycle connection across the site. This access easement shall be 12 feet in width in accordance with detail D-4 of the Design and Construction Criteria, Standards and Specifications for Streets, Sidewalks, Alleys and Other Public Ways. Paul Eckman had a meeting with the applicants attorney to discuss the Citys ability to require this of the applicant. We have not heard anything back on the results of that meeting or on Pauls interpretation on if we can do what we are asking for. Both Steve and I have asked Paul to keep up updated on what is happening. As the 12 foot easement width is not part of the LUC, but a part of our street standards the applicant can submit a variance request to modify this standard. If this request is received it would need to be reviewed by Gary Diede and Tom Frazier. * The landscaping and site plan as is now shown will not work with the future installation of a path connection. The light poles will not be allowed in the easement as they are a structure. The landscaping and tree placement needs to placed with consideration for the path. Since a 5 foot landscape strip is required this may have to be accommodated partially outside of the access easement as the easement is not wide enough to accommodate 5 feet of landscape and the path.
