HomeMy WebLinkAboutPEDERSEN AUTO PLAZA - PDP/FDP - 26-97 - CORRESPONDENCE - LEGAL DOCUMENTSRMAff,ilij, THIS DEED, made this day of 1 -11 Y 998, between THE NEW MERCER DITCH COMPANY, a Colorado mutual ditch company, of the county of Larimer, state of Colorado, Grantor, and PEDERSEN PROPERTIES, LTD., a Colorado limited partnership, whose legal address is 4455 South College Avenue, Fort Collins, Colorado 80525, of the county of Larimer, state of Colorado, Grantee, WITNESSETH, that the Grantor, for and in consideration of the sum of TEN DOLLARS ($10), the receipt and adequacy of which is hereby acknowledged, has remised, released, sold, and quitclaimed, and by these presents does remise, release, sell, and quitclaim unto the Grantee, its successors and assigns, forever, all the right, title, interest, claim and demand which the Grantor has in and to the real property, together with improvements, if any, situate lying and being in the county of Larimer, state of Colorado, described as follows: 'A part of Tract "B" of the Fossil Creek Commercial Plaza, City of Fort Collins, County of Larimer, State of Colorado, which is contained within the boundary lines which begin at the Southeast corner of said Tract "B" and run thence N 83°53'13" W. 436.88 feet; thence N 01 "06'24" E 4.98 feet; thence S 88 °53'36" E 67.00 feet; thence N 01 °06124" E 85.00 feet; thence N 88 °53'36" W 67.00 feet; thence N 01 °06'24" E 34.7.95 feet; thence S 89°46'52" E 279.56 feet; thence along the arc of a 400 foot radius curve to the left, a distance of 233.83 feet, the long chord of which bears S 20022' E 230.50 feet; thence along the arc of a 340 foot radius curve to the right, a distance of 226.18 feet, the long chord of which bears S 18 003'26" E 222.03 feet; thence S 01 "00' W 10.46 feet to the point of beginning. ✓ also known by street and number as; vacant land. THIS DEED SPECIFICALLY CONVEYS ANY RIGHTS THAT GRANTOR MAY HAVE IN ANY WATER DIVERSION STRUCTURE, SPECIFICALLY INCLUDING ANY PIPE LINE AND MANHOLE, LOCATED ON THE ABOVE -DESCRIBED PROPERTY; AND THE GRANTOR ABANDONS ANY RIGHT AND USE OF SAID STRUCTURE. TO Y.A`:r1L AND TO HOLD u'te same, together with all and singular the appurtenances and privileges thereunto belonging or in anywise thereunto appertaining, and all the estate, right, title, interest and claim whatsoever, of the Grantor, either in law or in equity, to the only proper use, benefit, and behoof of the Grantee, its heirs and assigns forever.
