Attached please find legal descriptions for the deck to be installed on the South
end of building "F", 1027 West Horsetooth Road, Poudre Valley Plaza. These
are submitted to clear up a discrepancy in the previously approved PUD which
shows a "future deck" in this location.
Please process any administrative changes required for construction of this
deck, including a minor amendment and/or easement vacation. If an easement
vacation is required, please consider the following background:
• Construction of this deck over the drainage easement does not affect the
function or capacity of the easement.
• Operations, maintenance, and liability for the easement remains with the
property owner, therefore the City realizes no additional exposure.
This request brings administrative requirements in line with the intent of the
original PUD.
