Your proposed change detracts from the quality of the community image established in the approved configuration. • Section 4.19 Neighborhood Commercial District subsection (E)(1)(a) of the LUC states that the development plan shall contribute to "a cohesive, continuous, visually related and functionally linked pattern within existing or approved development plans within the contiguous Neighborhood Commercial District area in terms of street and sidewalk layout, building siting and character and site design." Your proposed change is less compliant to this standard than the approved design. • Figure 1 in Section 3.2.1(E)(5) of the LUC shows a diagram with shaded areas that specify the landscaped areas that an applicant must include to "meet the interior landscaping requirements." This diagram clearly identifies a landscaped peninsula terminating the view of a major drive spine. 2) Your minor amendment application proposes an entryway to be placed outside the building envelope of pad "B." The location of this entryway seems to be the reason for the change in configuration of the parking lot peninsula. Staff will not grant you permission to build outside of the building envelope if by doing so, it creates non-compliance with standards in other review criteria. Staff will however grant you permission to build this entryway outside the building envelope if it does not create non- compliance in other standards (including but not limited to compromising the integrity or configuration - of the peninsula). Perhaps this can be done by moving this entryway to the north-east corner of the pad "B° building. 3) The only problem with the landscaping changes that are proposed is that the Water/Wastewater department has specified a condition to their approval of the minor amendment that you show water and sewer services & fire line on landscape plan and adjust landscaping to provide normal separation distances. An administrative hold has been put on pad B. In order for you to pull a building permit for pad B one of two things must happen. You must either propose to build it according to the approved plan, or get approval of a minor amendment, at which time the hold on your project will be cleared. You do not need to reapply for a minor amendment, but in order to continue with this application, you do need to submit a plan that satisfies the concerns expressed in this letter. If you disagree with this decision, you have the right to appeal and such request should be in writing and submitted to the Current Planning Department within fourteen (14) days of the date of mailing. Horsetooth Rd., Suite 200 Fort Collins, CO 80526 SUBJECT: Minor Amendment — Poudre Valley Plaza Building "B" Dear Mr. Snee: This letter is in response to your Minor Amendment application dated April 19, 1999. In that application, you requested that the City approve changes to an approved site development plan for: 1) change in parking lot layout to accommodate building design/function, 2) provide landscape design for building particularly on the west side. The Fort Collins Land Use Code (LUC) Section 2.2.10 allows an applicant/developer to make minor amends of an approved site specific development plan as long as the development application, as so amended, continues to comply with LUC standards, at least to the extent of its original compliance. Staff reviewed your application for compliance with the original LGDS standards and the LUC standards and for possible adverse effects your proposal may have on the overall Poudre Valley Plaza PUD development. Upon review of your application, your application is hereby denied based on the following: 1) You are proposing to put two parking spaces at the end of a major access view corridor where the original approved plans called for a landscaped peninsula. Your proposed change is at the western end of the major tree lined east -west access drive that comes off of Century Drive. The original configuration of the peninsula at this visual terminus satisfies both LDGS and LUC standards, however the new configuration satisfies neither. The standards are not satisfied as follows: • LDGS Section A-2.2 Building Placement and Orientation states in the FUNCTIONAL CONSIDERATIONS subcategory that building configurations must be designed "with an understanding of their implications for shaping outdoor space." Your proposed change clearly does not take the shaping of outdoor space into account as well as the approved configuration does. • LDGS Section A-2.13 Landscape states in the PURPOSE subcategory, "The effectiveness of the landscape plan will be evaluated considering the interrelationships between landscape elements like plant material and grading; and hardscape elements such as paving, walls, fences and other site amenities. All of these components should work together to create a landscape plan that enhances both the project and the neighborhood." Your original approved configuration provided an aesthetic interrelationship between hardscape elements and landscape elements.
