You should have received a phone call from Mickey Willis this afternoon regarding the Mason Street North
project under review. He has concerns with the requirement for the Railroad to be a signator on the plat
for the project (LUC Article 2, top of pg. 18). He's told me that the architect for the project has minutes
from a meeting 2 1/2 years ago where John Fischbach was present wherein they were told that the
Railroad would not have to sign the plans or plat, but I have no minutes from this meeting nor recollection
of it. I believe we did say at one point that the Railroad would not have to sign the utility plans or site and
landscape plans, but I do not think we would have told the developer that the Railroad signature on the
plat was waived. He's put in the call to you to request that this requirement be waived.
I'll be happy to answer any questions that you have regarding this,

Mickey,
I just wanted to offer up the following information so that you might more fully understand what brought up
my phone call to you yesterday afternoon regarding the need for the RR signature on the Mason Street
North plat:
I was speaking with Paul Eckman, a City Attorney, regarding what we would need from the RR regarding
the water main crossing under the RR easement when he brought up this paragraph 2.2.3 C 3.e.
regarding City requirements for signatures on the plat. This is the information that I then relayed to you.
The Director that can waive the requirements is Greg Byrne, the Director of CPES, which includes Current
and Advance Planning, and Natural Resources, but which does not include Engineering or other
Transportation Services. Our Director is Don Bachman.
I am not trying to put up roadblocks. I am simply trying to make sure that the project is completed
correctly and that the legal rights of all parties involved are protected. Unfortunately, I have no record of
the meeting you mentioned on November 26, 2001 (and can find no other staff member who does), where
you state that this requirement was waived, so I have to refer the issue to the person who can waive it:

Out of curiosity - Have you spoken with your attorney to see if he/she would sign the plans with the
standard attorney's certificate on the plat which states that "this subdivision plat has been duly executed
as required pursuant to Section 2.2.3(C)3(a) through (e) inclusive of the Land Use Code of the City of Fort
Collins..."

Agreements on parking variances:
Attached is the revised site and landscaping plans showing the agreement we reached after the meeting
yesterday. The revised elements are:
I. The driveway to the parking lot between buildings B and C is increased to 22' in width from 18'.
2. The driveway to the parking lot by Cherry Street is increased to 24' in width from 20'.
3. On the parking lot by Cherry Street the two parking spaces that were immediately to the east of the
entryway have been removed.

Agreements on railroad crossings:
The Project Team presented the options with and without the pedestrian crossing. The Team also
mentioned that they met the Burlington Northern officials on site (together with Mike Herzig) and that the
Rail Road officials were against the pedestrian crossing but informally said okay to any borings needed.
After some discussion, the city manager agreed not to hold the Mason Street North Project for Rail Road
crossings, i.e., not to have a signature line for Rail Roads on the drawings and not to require any boring or
pedestrian crossing permits in order to sign off the final plans.

Katie,
I have included a copy of notes from Korkut of Wolff -Lyon that were taken
some 3 years ago. Please review and reply. I believe that this issue is
going to get blown out of proportion in very short time if no solution can
get reached. I am trying to keep that from happening so that everybody can
be happy.
