Steve Olt of the Current Planning Department stated that his comments are on a red - lined Petition for Annexation and Zoning and a red -lined Annexation Plat that are being forwarded to the applicant. There are many discrepancies on both of the documents. This completes staff comments at this time. Additional comments may be forthcoming. Revisions to the Petition for Annexation, Annexation Plat, and Principals and Policies document made necessary by these comments, must be re -submitted to the City for review. Five (5) copies of the revised documentation should be sufficient at that time. The tentative schedule for the public hearings for this annexation and zoning request is as follows (if the outstanding issues are resolved and the necessary revised documents are submitted in time for City staff to review them): * Planning and Zoning Board: January 18, 2001 (Recommendation to City Council) * Initiating Resolution, City Council: January 2, 2001 * First Reading, City Council: February 6, 2001 * Second Reading, City Council: February 20, 2001 * Effective Date of Annexation: March 2, 2001 Please contact me at 221-6341, if you have questions about these comments or tentative dates of the scheduled public hearings. Ellen Switzer of the Light & Power Department stated that this area is within the service territory of Poudre Valley Rural Electric Association (REA). The City of Fort Collins will assume responsibility for electric service to the area at some point following annexation. Poudre Valley REA service rights fees will apply to the electric service for 10 years after the date of transfer to the City of Fort Collins Utilities Light & Power. Please see the attached letter to the property owners regarding this issue. 2. Terry Farrill of the Fort Collins -Loveland Water District and the South Fort Collins Sanitation District stated that they have reviewed the annexation and zoning request and have no comments at this time. 3. Ken Waido, Chief Planner for the Advance Planning Department, offered the following comments: a. If the City is not supporting the rezoning request from C — Commercial to NC — Neighborhood Commercial for the area to the north and west of this property (the Timan Property), and at this time the City is not supporting the request, then why should the City support NC zoning for this property? The City's Structure Plan shows the area as part of the South College Avenue commercial corridor. b. A small (about 4 acres) parcel of NC zoning would not help implement City Plan goals for a neighborhood center. Such centers are envisioned to be 15 - 20 acres in size and developed with 150,000 to 200,000 square feet of retail and service uses. C. If the City were to support the rezoning request from C — Commercial to NC — Neighborhood Commercial for the area to the north and west of this property, then the City should support NC zoning for this property. 4. Peter Barnes of the Zoning Department stated that any signs that might be located on the property must be brought into compliance with the Sign Code within 5 years from the date of annexation. However, this does not apply to any off -premise signs that might be on the property. 5. Craig Foreman of the Parks Planning Department stated that they have no concerns or comments regarding this annexation and zoning request. 6. Paul Eckman of the City Attorney's Office stated that he has concerns with the original Petition for Annexation and Zoning. His comments on the revised Petition have not yet been received. 7. Gary Huett of Public Service Company of Colorado stated that they have no concerns or comments regarding this annexation and zoning request. and Environmental Current City of Fort Collins December 14, 2000 Jim Sell Design c/o John Barnett 153 West Mountain Avenue Fort Collins, CO. 80524 Dear John, Staff has reviewed the Front Range Annexation and Zoning documentation (including the Petition and Annexation Plat) that was submitted to the City on September 13, 2000, and would like to offer the following comments: The original Petition for Annexation and Zoning, Annexation Plat, and Principals and Policies for the Timan Annexation were submitted to the City on September 13, 2000 to meet an imposed State-wide deadline associated with the Amendment 24, Growth Initiative placed on the November 7, 2000 election ballot. This annexation and zoning request was not routed through the City of Fort Collins development review process until November 15, 2000. • The original Petition for Annexation and Zoning referenced the Timan Annexation, for 162.2312 acres to be placed in the C — Commercial Zoning District. The Annexation Plat was titled the Timan Second Annexation, for 4.838 acres. The Principals and Policies document (dated 9/11/00) was titled Timan Annexation and states that the request complies with the City's Structure Plan. The requested C District does comply with the Structure Plan. • A revised Petition for Annexation and Zoning, submitted to the City on December 8, 2000, references the Front Range Annexation, for 4.838 acres to be placed in the NC — Neighborhood Commercial Zoning District. No new Annexation Plat was submitted; therefore, it is still titled the Timan Second Annexation, for 4.838 acres. No new Principals and Policies document was submitted; therefore it is still titled Timan Annexation and states that the request complies with the City's Structure Plan. The requested NC District does not comply with the Structure Plan. This all begs the question: What is the correct information regarding this annexation and zoning request? 281 North College Avenue • PO.
