RE: Request for Extension of Vested Rights
Rigden Farm Fourteenth Filing
Dear Mr. Dush,
On August 31, 2007, the City of Fort Collins approved the Rigden Farm, Fourteenth Filing development
plans. Pursuant to paragraph 2.2.11(D)(3) of the Fort Collins Land Use Code, the term of vested rights is a
maximum of three years. The code makes provision for up to two one-year extensions of vested rights to be
granted by the Director, as set forth in paragraph 2.2.11(D)(4).
Pursuant to paragraph 2.2.1 l(D)(4), Ladco Properties, LLC hereby requests that you, as Director, grant an
extension of the vested rights for Rigden Farm, Fourteenth Filing to August 31, 2011. We make this request
because the current economic climate prevents us from prudently developing the project. Although we have
been diligently seeking buyers or tenants, we simply have not found any office or retail users willing to
commit to purchase or lease a building at this site. Installing the infrastructure without an end -user would
put Ladco at huge financial risk, and would put an undue hardship on the company.

Subject: Rigden Farm, Fourteenth Filing - Final Plan Approval
Dear Mr. Tiller,
The City of Fort Collins has reviewed and approved your request for a one year
extension to the Rigden Farm, Fourteenth Filing - Final Plan, originally approved on
August 31, 2007. Based on this extension, all engineering improvements in accordance
with your approved utility plans must be completed no later than August 31, 2011.
Pursuant to Section 2.2.11(D)(4) of the Land Use Code, the Director is authorized to
grant an additional one year extension should you find that the above new deadline
cannot be met. Please note that additional requests beyond the two consecutive one
year periods fall outside my purview and may only be authorized by the Planning &
Zoning Board.
