Pursuant to paragraph 2.2.11(D)(3) of the Fort Collins Land Use Code, the term of vested rights is a maximum of three years. The code makes provision for up to two one-year extensions of vested rights to be granted by the Director, as set forth in paragraph 2.2.11(D)(4). Pursuant to paragraph 2.2.1 l(D)(4), Ladco Properties, LLC hereby requests that you, as Director, grant an extension of the vested rights for Rigden Farm, Fourteenth Filing to August 31, 2011. We make this request because the current economic climate prevents us from prudently developing the project. Although we have been diligently seeking buyers or tenants, we simply have not found any office or retail users willing to commit to purchase or lease a building at this site. Installing the infrastructure without an end -user would put Ladco at huge financial risk, and would put an undue hardship on the company. Thank you for your consideration. Sincerely yours, Donald R.
