Has the PDP been approved, or is this final compliance review part of that process (or a separate process)? The City of Fort Collins development review is a 2-step process: 1. Project Development Plan (PDP) Per Section 2.1.3(C)(1) of the City's Land Use Code (LUC), the PDP contains a general description of the uses of land, the layout of landscaping, circulation, architectural elevations and buildings, and subdivision plat. Approval of a PDP does not establish any vested right to develop property in accordance with the plan; however, the approved PDP does establish the land uses and layout (site plan, landscape plan, architectural character and intent, street layout & design, utilities, storm drainage) for the property. - After development review to evaluate the plan's compliance with the LUC, engineering standards, and applicable regulations, the PDP ultimately goes to a public hearing before the appropriate Decision Maker (an administrative hearing officer or the Planning and Zoning Board). - Per Section 2.2.11(C) of the LUC: Within a maximum of 3 years following approval of a PDP, the applicant must proceed by obtaining approval of a Final Plan for all or part of the PDP. If such approval is not timely obtained, the PDP shall automatically lapse and become null and void. 2. Final Plan, also known as Final Compliance (FC) * Per Section 2.1.3(D)(1) of the LUC, the Final Plan is the site specific development plan which describes and establishes the type and intensity of use for a specific parcel of property. The Final Plan set shall include a Site Plan, Landscape Plan, Building Elevations, the final subdivision plat, and utility plans with detailed engineering. At this time a Development Agreement between the developer and the City is created. - The Final Plan is reviewed, approved, and recorded administratively. It does not go to a public hearing. - Per Section 2.2.11(D)(3) of the LUC: Within a maximum of 3 years following approval of a Final Plan, the applicant must undertake, install and complete all engineering improvements (water, sewer, streets, curb, gutter, street lights, fire hydrants and storm drainage) in accordance with City codes, rules and regulations.The period of time shall constitute the "term of vested property right". Failure to undertake and complete the development within the term of the vested property right shall cause a forfeiture of the vested property right and shall require resubmission of all materials and reapproval of the same to be processed as required by the LUC. The developer for the Spectrum Independent Living Facility has completed the 1 st step, the PDP process, and has been granted approval of the plan. Within the 3-year time frame following approval of the PDP the developer has submitted Final Plans, which are currently under review by the City. The PDP will not expire unless Final Plans are not approved within the 3-year time frame starting on May 19, 2005 (meaning an expiration date of May 19, 2008). The developer for the Spectrum Independent Living Facility is in the 2nd step process, being the review of Final Plans. If the Final Plans are administratively approved and recorded and the developer achieves "substantial completion" of the project, per Section 2.2.11(D)(3) of the LUC, within 3 years of the Final
