[4/17/07] With a car parked at the proposed vacuum location it would appear that traffic movement
and flow in this area would be very awkward. It could become a real "pinch point" if a car is fueling
on the north side of the northerly set of pumps.
Response: The vacuum location has been moved to the north corner of the site, northwest of the fuel
pumps, to avoid the potential traffic conflicts in this area. This location does allow vehicles to pass
and enter into the car wash while vehicle is parked at the vacuum..

variance request if driveway spacing is not met there either.
Response: A variance request has been submitted by Matt Delich and approved by Eric Bracke for
this spacing requirement. The variance letter is enclosed for reference. The accesses to the property
are the same as originally submitted.

is to be built by East Ridge as existing (greyscale) and black for everything that this project is
proposing to be built. Will need to provide stub outs for all utilities on the East Ridge plans and then
show as existing on this plan set OR show as proposed with this development and show all
appropriate street cuts. Keep in mind that any street cut within 5 years of installation or rehab
requires triple street cut fees.
Response: All of the existing East Ridge line work has been shown as grayscale and the proposed
improvements for the C-Store as black. The C-Store plans are being coordinated with East Ridge to
minimize potential street cuts.

[4/17/071 The convenience store building does not satisfy the "build -to" line requirement, relative to
Vicot Way and Sykes Drive, as set forth in Section 3.5.3(B)(2)(b) of the LUC. Therefore, a request
for a modification of this standard must be submitted immediately for City staff and Planning &
Zoning Board review. The Board will be the ultimate decision maker. The applicant's request and
justification must be supported by the criteria set forth in Section 2.8.2(H) of the LUC.
Response: The convenience store building has been enlarged to satisfy this requirement. The south
side of the building has been located as close to the ROW of Sykes Drive as possible due to the 9'
utility easement along Sykes (most of the south side is within 15' of the ROW). The east side of the
building has been located as far to the east as possible and is constrained by a drainage easement
along the Vicot ROW. An outdoor plaza space has been incorporated on the southeast side.

[4/17/07] The applicant must demonstrate how this neighborhood center satisfies Section
4.5(13)(3)(C)1 of the LUC. It proposes a convenience retail store w/fuel sales and a car wash. Looking
at Sections 4.5(13)(2)(c)3 and 4.5(13)(3)(c)1, requiring at least 2 uses defined in these sections, it
appears that the proposed convenience retail store w/fuel sales use is the only (one) use out of the
permitted uses in a neighborhood center. A car wash is not listed in either section.
Response: The East Ridge ODP and PDP identify several tracts (tracts D, E, and V) within close
proximity of the C-Store site as a part of the overall East Ridge neighborhood center. These tracts
will be developed independently, but will be required to have at least one or more other non-
residential uses and an outdoor space that will satisfy this requirement.
The C-Store project will provide the convenience retail store w/fuel sales and an accessory carwash.
In addition a fast food restaurant will be located within the convenience store. An outdoor dining
space has been provided adjacent to the C-Store for the fast food restaurant.

[4/17/07] Technically speaking, Section 3.2.1(D)(3) Minimum Species Diversity of the LUC would
allow a maximum of 50% of any one species of tree in the development plan. In this case that would
be 50% of 17 trees, or 8.5 (rounded down to 8, as the City does) Ash or Honeylocust. Is there an
acceptable alternative to 1 or 2 of the Ash trees?
Response: A third tree has been added to the Landscape Plan to provide for greater species diversity
and satisfy this requirement.
Topic: Lighting Plan

[4/17/07] Sections 3.2.4(C) & (D) of the LUC sets forth the allowable lighting levels for a
development, including around and under a canopy. Maximum under -canopy area lighting (initial
installation) is 26.0 foot-candles; and, maximum under -canopy area lighting (average maintained) is
20.0 foot-candles. There are several spots shown on the Lighting & Photometric Plan under the
canopy that exceed 26.0 foot-candles, whether they are initial installation or average maintained.
Many of the spots, if they are average maintained levels, are too high. Please clarify. Also, there are
many spot foot-candle levels shown just outside the canopy lines that exceed the maximum allowed
on -site lighting levels of 10 foot-candles. The under -canopy lights must be fully recessed into the
structure's "ceiling", assuring that the lights will be down -directional.

submittal for the EAST RIDGE GSTORE, PDP — TYPE 2 and have incorporated responses to the
comments in our PROJECT DEVELOPMENT PLAN documents (attached with this letter). The
following is our narrative response (in italicized text) to each of the comments.

[4/12/07] Confirm location and separation of convenience retail w/fuel sales is at least 3/4 mile from
any other such use, per Land Use Code (LUC) Section 4.5(3)(c)(1).
Response: There are no other convenience retail w/fuel sales uses within 314 mile from this proposed
convenience store. The C-Store that was proposed for Waterfield has expired and is no longer valid.

[4/17/07] The Conceptual Architectural Elevations Plan as provided with the Project Development
Plan (PDP) submittal is sufficient at this phase of development review. However, with the Final
Compliance submittal the building elevations must be more defined for this particular site and the
plan must show heights, materials, and "general" colors to be used. The canopy over the gas tanks
must be designed with a shallow -pitched roof, false mansard or parapet that matches the building.
Response: Acknowledged, more detailed elevations will be submitted at Final Compliance. -In
addition, the canopy roof will be designed to match the building. •
