the zone change shall be the date the amendment to the Fort Collins City Structure Plan
for the GMA Zone District expansion area is approved.
3. That the Larimer County Land Use Code Section 8.9.3 (Supplementary
Regulations for the Fossil Creek Cooperative Planning Area) shall be repealed in its
entirety. The effective date of the repeal shall be the date the amendment to the Fort
Collins City Structure Plan for the GMA Zone District expansion area is approved.
4. The Chair of the Board of County Commissioners be authorized to sign an
amendment to the existing Intergovernmental Agreement with Fort Collins that adds a
new map that reflects the expanded GMA boundary as agreed to by the City of Fort
Collins and Larimer County.
5. That the Chair of the Board of County Commissioners be authorized to
sign the documents approved by the County Attorney to effect the repeal of the existing
Intergovernmental Agreement titled "Intergovernmental Agreement regarding
Development in the Fort Collins Cooperative Planning Area Adjacent to Fossil Creek
Reservoir" dated August 31,1999. Such documents shall not, however, be signed until
after the effective date of the GMA Overlay Zone District Expansion into the Fossil
Creek Area.

municipality. In that IGA, Section 2.2 states that land in the Loveland CPA may
eventually be annexed to the City of Loveland. Therefore, in its IGA with the County,
annexation of CPA areas is anticipated. Also, Section 3.3.6 of the County/Loveland IGA
states that the City of Loveland will not annex into a GMA or CPA of another
municipality if such are is recognized by the County. Section 3.3.7 of the
County/Loveland IGA states the City of Loveland will not annex property north of
County Road 30 unless the County either requires the landowner to petition for
annexation or requests the City of Loveland consider annexation.
e. The Larimer County/Windsor IGA acknowledges that Windsor will not
annex into any County -recognized CPA of another municipality.
f Since the above are all in the County -adopted documents, they reflect the
County's position on the I-25/Highway 392 Interchange area west of I-25 and the
expansion of the Fort Collins GMA into the Fort Collins CPA.
WHEREAS, the Larimer County GMA Amendment Criteria and the City of Fort
Collins GMA Amendment Criteria have been met as more particularly described in the
Planning Division Staff Report in the July 11, 2005 Agenda; and
WHEREAS, the Larimer County Planning Commission considered the Proposals
at a public hearing on June 15, 2005, which hearing was advertised in a newspaper of
general circulation as required by law and, by resolution, made its recommendation that
the proposals be adopted; and
WHEREAS, the Board of County Commissioners of Larimer County considered
the Proposals at a public hearing on July 11, 2005, which hearing was advertised in a
newspaper of general circulation as required by law; and
WHEREAS, the Board of County Commissioners finds that adoption of the
Proposals is duly authorized by law and will promote the health, safety and welfare of the
citizens of Larimer County.
NOW, THEREFORE, BE IT RESOLVED:
1. That the Fort Collins GMA Overlay Zone District, file #05-Z1544, be
applied to the geographic area as shown on the attached Map 1 dated February 1, 2005,
and that the effective date of the GMA Zone District boundary change shall be the date
the amendment to Fort Collins City Structure Plan for this GMA Zone District expansion
area is approved. Prior to the Board of County Commissioners signing the amended
Intergovernmental Agreement (IGA) with the City of Fort Collins, the Board of County
Commissioners shall receive what they deem to be sufficient assurances that the City will
be an. active participant in efforts to provide Adequate Public Facility of the
I-25/Highway 392 Interchange and Carpenter Road.

RESOLUTION ADOPTING AMENDMENTS TO THE LARE%IER COUNTY
LAND USE CODE, EXPANDING THE FORT COLLINS GROWTH
MANAGEMENT AREA AND REPEALING THE FORT COLLINS
COOPERATIVE PLANNING AREA OVERLAY ZONE DISTRICT
(DATE EFFECTIVE IS AS STATED BELOW)
WHEREAS, the Larimer County Planning Division has proposed (i) to expand
the area subject to the Fort Collins Growth Management Area Overlay Zone District to
the area shown on the attached Map 1 dated February 2005, (ii) to repeal the existing
Cooperative Planning Area Overlay Zone District from the property adjacent to Fossil
Creek Reservoir as described on Exhibit "A" attached hereto, (iii) to repeal Section 8.9.3
of the Larimer County Land Use Code (Supplementary Regulations for Cooperative
Planning Areas), and (iv) that the Board of County Commissioners authorize that
amendments to the Fort Collins Intergovernmental be approved and signed (collectively
referred to as "Proposals"); and
WHEREAS, the following facts support the Proposals:
a. One of the original purposes of a municipality's Cooperative Planning
Area (CPA) is that it would eventually become part of that municipality's Growth
Management Area (GMA). Both the GMA and CPA boundaries are intended to enable a
municipality to define its future growth area to facilitate long range planning and to
minimise or eliminate "annexation wars."
b. The Fossil Creek Reservoir Area Plan, jointly adopted by the City and
County, anticipated potential expansion of the Fort Collins GMA into the Fossil Creek
CPA. The Plan clearly anticipated that the area could eventually be annexed to the City
of Fort Collins.
C. Several intergovernmental agreements (Larimer County/Fort Collins IGA
and the Fort Collins/Loveland/Windsor/Larimer County IGA) acknowledge that the
Fossil Creek CPA could be annexed into Fort Collins. The four -party IGA states that no
municipal annexations shall occur within the Fort Collins CPA except annexations to Fort
Collins, and that the County agrees to oppose, by such means as it deems appropriate, any
annexation into the Fort. Collins CPA by an incorporated town or city.
d. The Larimer County/Loveland IGA adopted January 12, 2004
acknowledges that Loveland will not annex into any County -recognized CPA of another

governing the development design of large "big box" retail establishments and
regulations requiring compatibility of development with surrounding uses.
Perhaps the most important development related issue for the area is the need for the
eventual improvement to the I-25/Carpenter Road interchange. The question remains as
to who pays the costs for this needed improvement? It is likely a combination of both
public and private funds will be necessary. Therefore, it is important that future land uses
in the area be able to generate sufficient tax revenues to contribute to the improvements
of the I-25 interchange.
The open house is designed to provide information on the potential land use options to
the general public. The open house will not be a forum for debate on the land use
options. No decisions as to which land use option should be adopted will be made at the
open house. City staff has not yet formulated a recommendation on any particular option.
Public hearings by the Fort Collins Planning and Zoning Board and City Council will be
scheduled in the future which will allow for broad public input on any land use changes.

Dear Interested Citizens,
The Fort Collins City Council and the Larimer County Commissioners have agreed in
concept to expand the Fort Collins Growth Management Area (GMA) boundary to
include the former Fossil Creek Cooperative Planning Area (CPA). See the map on the
reverse side of this letter for the area to be added into the Fort Collins GMA. Inclusion of
the former Fossil Creek CPA into the Fort Collins GMA boundary sets the stage for
eventual annexation of the area into the Fort Collins city limits.
The City Council has also directed City staff to work with property -owners in the area to
see if any land use/zoning changes are appropriate in order to deal with a variety of
development related issues in the area, including but not limited to, the need to improve
the I-25 interchange and Carpenter Road, compatibility of future development with
surrounding existing land uses, preservation of open lands as part of the Loveland -Fort
Collins community separator, and mitigation of development impacts on existing
wetlands and natural areas.
City staff has developed several potential land use options for land use changes in the
area and will be presenting them at a public open house to be held:

The land use options to be presented differ primarily in the amount of land devoted to
commercial (retail) and employment (office and light industrial) uses. In addition to land
use maps and data, information will be presented on potential impact fee and sales tax
revenues that could be generated from future development, the costs of providing City
services to the area, the City's Land Use Code (Zoning Ordinance) and its regulations
