With that being the case, the design team would like to submit a new design for the storm
and sanitary sewers. This new design will both mitigate the current issue of attaining an
easement across JD Padilla's property, as well as solve an area problem concerning future
tie-ins for new construction in this area. The following graph shows an alternate route
for the 30" storm line, and (2) viable options for the 8" sanitary sewer line.

Both of these design options will require to some extent horizontal boring and
coordination along Harmony Road and the Union Pacific Railroad. Furthermore, these
designs will benefit future developments in this entire region by creating a central
location for new tie-ins. As of now, it is evident that this is an issue that needs to be
addressed, and with the help of Fort Collins this issue can be resolved in a timely matter.
With that being said, the design team would like to confirm that the city of Fort Collins
still has the intention to cover the costs for the installation of the infrastructure, in which
case the design team will move forward in finalizing the sewer layout.

BACKGROUND:
Mark Holmes of Exit Enterprises, LLC along with his design team is developing a
triangular lot located on the NW comer of Harmony Road and Timberline Road. The
future site will be an animal hospital, Paws of the Rockies, along with two other office
buildings. This lot is highlighted below in yellow. Initially, the design team and the city
of Fort Collins were in agreement that Fort Collins was going to pay for the costs of
installing these sewer lines because it was solving a regional issue concerning future
sewer tie-ins. In the initial design of the property layout, the design team was under the
assumption that the adjacent property owner at that time, Gerrard Family Limited
Partnership, was willing to grant an easement on their property for the storm and sanitary
sewers. The map below shows the initial design for the storm and sanitary lines.

After the design of the utilities was complete, the parcel of land was sold from Gerrard
Family Limited Partnership to JD Padilla with no recorded easements on the property.
The design team including Mark Holmes has held multiple meetings, discussions, and
negotiations with JD Padilla to address this situation and alleviate his concerns and it is
apparent he will not work with the design team in a timely fashion to grant an easement
to gain access across his property.
