Explanation — This concerns new information that came in after the deadline but that can affect a
better location for the cell phone tower that what appeared available at the time of the proposal.
The P&Z, understandably could not factor in new info that arrived after the deadline. We are
appealing so this new info can now be considered as a winaivhn solution for everyone. .
Debits: Michael Sdnekel 303-776-Z766, who is a Regional Manager for "Soopers off to
explore bolting at the roof or other site locations so the impact of the tower would not be on
neighbors. Prior to this, Chris Stryker (applicant) was [irnfisd on the choices he could consider for
the location of the tower.
In talking with Arne Aspen, the suggestion was made to appeal the decision so Chris can withdrew
his application and Michael and he can then determine if a better location is still possible.
The initial site proposed for this was rejected as the boxier was a visual impairment to an existing
neighborhood, yet when the tower was moved closer to the Keg Soopers building, it was also then
actually closer to the two backyards of our properties. So in effect, the same visual impairment
Issue remains which should have held up as an enforceable concern. We were surprised the
criteria that protects neighborhoods from such an impact was not enforced a second time as it was
dear it still existed as an issue. That said, all we want is the best anyone can do to reach as sound
a solution for all interests as possible, which this may now aft d.

Btil & Fran Van Eron own a rental tat has a back yard that opens to the proposed placement of
the 50 foot cell tower. The cell phone tower visual impairment would be cause for us to lose our
tenants in a market where we went 6 morbhs without a renter and already lowered the cost by
$100 a month. Perceptions are a critical aspect in determining a property value whether as a
residence or as a rental. Current market conditions (high rental vacancy rates and poor row estate
market) also need to be factored in and may not have been. Zoning may afford others the right to
put In a given structure but they must also account for the impact on surrounding propeHan which
this solution, as accepted with conditions, was unable to satisfy our requests.
Wendy & John Clark live the closest to the proposed wit tower location as it opens to their bads
yard. They spend a great deal of time in their back yard and have expressed strong opinions that
the view of the tower would greatly contrast thhe scale of a ranch and inipact their view and property
value Moving this to the rooftop or other K ft Soopers location wound greedy satisfy Wendy and
John's concerns.

The Applicant has submitted a Project Development Plan (referred to herein as the
'Project" or the °PDP) requesting approval to install a 50-fbot tall freestanding wireless
telecommunication monopole, in a stealth sheath configuration, east of the rear service
drive aisle and adjacent to the King Soopers grocery stone. This is the second request for
