I told them to hold off on the mailing until I hear back from you. I don't want a 300-piece mailing to go out to your neighbors if we cancel the appeal. I have been consumed with work and preparing for our hearing tonight. If we back off of our appeal for the cell tower, do we still get refunded. If so, then we will back off. Our only point of defense is that little has changed between the reason it was turned down to begin with and where it is now so we had hopes to establish that point alone, that this monster tower was still a violation of scale. As I understand scale now, only a 15% ratio increase is acceptable and this exceeds that. Let us know. Sara told me that they would need a brief written statement that you wish to rescind the appeal but if they receive that, they will give you back your check. I understand your concerns with the tower's lack of compatibility with your homes. If you choose to drop the appeal, I hope that a mutually beneficial arrangement can be made for trees to buffer the tower as required by the administrative hearing decision. I'm not sure what you are referring to with the 15% ratio increase —something from the hospital? --but I do not believe that would apply in this case. The standards that apply to cell phone towers are located in Section 3.8.13 and the compatibility standards
