the existing 60' row.

[5/5/08] A retaining wall around a detention pond is now shown on the east end of
the property and located within the utility easement. A variance from the utilities
must be approved for structures of any kind. If you would rather not request a
variance, you can pull the walls out of the easement instead.

[5/2/08] [2/27/08] Only highlighted items on Appendix E4 were reviewed. All other
items will be looked at in Final Compliance.

[5/2/08] Just keeping this comment open to make sure this gets credited in Final
Compliance.
[2/27/08] The TDRF fees were overpaid by $52.50 and a credit of that amount will
be given towards the Final Compliance fee.

[5/2/08] Please dedicate an additional l' utility easement along Cameron for a total
of 9'. All easements will be processed in Final Compliance.

[5/5/08] Just a heads up - In order for this project to pull a building permit, all public
infrastructure must be in place, including the portion of the road being constructed
with the Redtail development. If this project wants to go first, then this development
will have to build its street frontage in accordance with the Redtail plans and provide
a letter or credit or bond for the public infrastructure and pay the inspection fees for
that frontage. Let me know if the timing of these two projects becomes an issue and
we'll work it out in the Development Construction Permit stage.

[5/6/08] Final compliance - the emergency access easement required by PFA can .
be completed during FC with the other easements being dedicated.
Topic: Public Hearing
Number: 55 Created: 5/8/2008
[5/8/08] To go to hearing, we'll just need a grading sheet submitted to verify that the
retaining wall has been moved out of the utility easement and that the extra foot of
UE has been dedicated. If the retaining wall is to stay, then we'll need a variance
request submitted so that I can route that to the utility departments for their review.
We'll need to know tow and bow so that they know whether or not the retaining wall
will be a problem for them or not. Thank you.

Topic: Public Hearing
Number: 56 Created: 5/9/2008
[5/9/08] In addition to the grading sheet that Susan has requested, I will need one
full size set of plans (site, landscape and elevations - updated with the retaining wall
revisions if that is the route you choose) in order to schedule the public hearing. A
digital copy of these plans (PDF) would also be helpful but will not be required.
Once I have the revised plans I will coordinate a date for the Public Hearing.
Notification letters will need to go out 2 weeks prior to the hearing date, so at this
point it looks like we will be scheduling a hearing the last week of May or early June.
Topic: Water/Wastewater

[5/7/08] Fort Collins Loveland Water District / South Fort Collins Sanitation District
(Terry Farrill) has provided the following comments:
1. The District will require 20 foot easements on the District's standard
easement form for the fire hydrant line.
2. The District does not allow trees, tree canopies or landscaping within the
District's easement or within 10 feet of District facilities. Trees that are placed
on the easement lines may be lost due to the removal of 50% of the canopy
during maintenance operations. The District will not be responsible for lost
trees.
3. The Districts commercial review packet was not submitted with the review
submittal as requested.
The District will require another review due to the lack of information requested.
Please do not hesitate to contact Terry at 226-3104, ext. 104 if you have any
questions or require additional information.

[5/2/08] The applicant was given the choice of detaching the walk to standard OR
providing a 6' attached walk. The developer has chosen the 6"attached. Please
— add this as approved variance to line 48 of the General Notes.
[2/27/08] The existing sidewalk was inspected by Tracy Dyer, our Chief
Construction Inspector. It was determined that the existing walk will be required to
be removed and replaced because it is damaged and in poor condition (see line 42
of the LCUASS General Notes). Because of this, we will require that the walk be
detached to standard (see figure 7-90. Please coordinate with the Redtail
Development to the west so that they are no longer tapering in their sidewalk to
meet the existing attached sidewalk on this project. The entire stretch of sidewalk
from Redtail to the eastern edge of Lot 5's property will now be detached to
standard.

Staff has reviewed your submittal for Fossil Creek Office Park Lot 5 PDP-Type I, and
we offer the following comments:
ISSUES:
Department: Current Planning Issue Contact: Shelby Sommer
Topic: Building Elevations
Number: 14 Created: 2/21 /2008
[5/6/08] Your justification for the building elevations and their site -specific design is
acceptable; however keep in mind that future buildings beyond this office park
development will need to comply with current commercial building design
requirements.
[2/21/08] Per Section 3.5.3(D), all building facades need a recognizable "base"
consisting of (but not limited to): thicker walls, ledges or sills, integrally textured
materials such as stone or other masonry, integrally colored and patterned materials
such as smooth -finished stone or tile, lighter or darker colored materials, mullions or
panels or planters.
Topic: Fire
Number: 41 Created: 4/28/2008
[4/28/08] Per PFA (Cane Dann) the buildings are considered out of access,
therefore an emergency access easement (fire lane) will be required. This may be
dedicated by separate document.
Topic: Landscape Plan
Number: 44 Created: 5/2/2008
[5/2/08] Because of the street light/street tree conflict, please plant ornamental trees
on both sides of the streetlight along the northern edge of the site (see redlines for
locations). Also, an ornamental tree is required along the eastern edge of the site, in
lieu of a typical street tree because of a streetlight conflict. Please remember that
ornamental trees need to be placed at least 15 feet from any streetlight. This can be
revised prior to the hearing or I will add it as a condition of approval.
Number: 45 Created: 5/2/2008
[5/2/08] In order for each of the areas identified on the landscape plan as "IL"
(Interior Landscaping) to count as parking lot interior landscaping, a minimum of one
canopy shade tree is required per area. See redlines for locations. This can be
added to the plans prior to the hearing or I will add it as a condition of approval.
