4. Public Comment
At the Administrative Hearing, public comment was received by an area resident
expressing concern regarding potential future impacts to historic houses fronting
Trilby Road if the road is widened at some point in the future. While these
comments were entered into the public record, it is acknowledged that the
requested subdivision will not trigger the immediate need for the widening of
Trilby Road.
SUMMARY OF CONCLUSIONS
A. The C.O.L. College and Trilby Subdivision Project Development Plan is subject
to administrative review and the requirements of the Land Use Code (LUC).
B. There are no development standards in the NC zone district applicable to the
C.O.L. College and Trilby Subdivision Project Development Plan.
C. The C.O.L. College and Trilby Subdivision Project Development Plan complies
with all applicable General Development Standards, including the Plat Standards,
contained in Article 3 of the Land Use Code.
DECISION
The C.O.L. College and Trilby Subdivision Project Development Plan, #32-04A, is
hereby approved by the Hearing Officer without condition.
Dated this 3rd day of February, 2005 per authority granted by Sections
1.4.9(E) and 2.1 of the Land Use Code.

FACTS AND FINDINGS
1. Site Context
The surrounding zoning and land uses are as follows:
N: NC; existing single family residence and undeveloped
S: C (Larimer County); existing commercial and residential
W: NC; undeveloped
E: I; existing retail and other commercial uses.
This property was annexed into the City as part of the College and Trilby
Annexation in November, 2004. It has not previously been subdivided.
The existing improvements on the property (vacant building, parking area,
landscaping and stormwater detention area) were developed while under Larimer
County jurisdiction and their adopted development standards.
2. Compliance with Article 4 and the NC Zoning District Standards:
The are no land use or development standards within Article Four of the Land
Use Code applicable to this plat request.
3. Compliance with Article 3 of the Land Use Code — General Development
Standards
A. Section 3.3.1 (B) — Lots
The plat provides for direct vehicular access from streets (S. College and Trilby
Roads) to the proposed lots. Lots have been configured in a regular shape and
substantially at a right angle to streets. Therefore, this standard has been met.
B. Section 3.3.1 [C] (1) - Public Sites, Reservations, and Dedications
The plat indicates that dedications for access, emergency access and drainage
easements are provided as needed to serve the lots. Furthermore, forty five point
five one (45.51) feet of right-of-way is being dedicated along Trilby as part of the
plat to accommodate potential future road widening. Several other easements
necessary to serve the development, including an additional road right-of-way
reservation, cross -easements for ingress/egress, site circulation, stormwater
detention and site drainage were previously dedicated to the public.

PUBLIC HEARING
The Hearing Officer, presiding pursuant to the Fort Collins Land Use Code, opened the
hearing at approximately 3:00 p.m. on February 2, 2005 in Conference Rooms C and D
at 281 North College Avenue, Fort Collins, Colorado.
HEARING TESTIMONY, WRITTEN COMMENTS AND OTHER EVIDENCE:
The Hearing Officer accepted during the hearing the following evidence: (1) Planning
Department Staff Report; (2) application, plans, maps and other supporting documents
submitted by the applicant and the applicant's representatives to the City of Fort Collins;
(3) a sign up sheet of persons attending the hearing; and (4) a tape recording of
testimony provided during the hearing. The LUC, the City's Comprehensive Plan (City
Plan), and the formally promulgated policies of the City are all considered part of the
evidence considered by the Hearing Officer.

The Applicant has submitted a request to plat a 3.88 acre parcel of land, presently
described by a metes and bounds legal description, into two (2) lots. The property is
located at the northwest corner of S. College Ave (State Highway 287) and Trilby Road.
There is one existing vacant building on the property, along with site improvements
including paved parking areas, landscaping and a stormwater detention area.
