9. Mark Jackson of the Transportation Planning Department stated that they have no
comments regarding the annexation and zoning. They will make more detailed comments
when an Overall Development Plan and/or Project Development Plan come into the City
for review.
10. Gary Huett of Public Service Company of Colorado stated that they have no concerns
or comments regarding this annexation and zoning request.
11. Steve Olt of the Current Planning Department stated that his comments are on a red -
lined Annexation Plat that is being forwarded to the applicant.
The following comments were offered at the City Staff Review Meeting on December 6, 2000:
12. The Petitioner must annex all of the Valley View Road ROW. The boundary line for the
annexation must then be changed.
13. Any proposed future storm drainage to Richards Lake will be determined with a Project
Development Plan. The Water Supply & Storage Company (owners of Richards Lake) do
not always accept runoff from adjacent properties.
14. This property will be served by outside/private water and sanitary sewer districts.
15. How much acreage is being proposed for annexation? Neither the Petition nor the
Annexation Plat indicates an acreage.
This completes staff comments at this time. Revisions to the Petition and Annexation Plat, made
necessary by these comments, must be re -submitted to the City for review. Five (5) copies of the
revised plat should be sufficient at that time. The tentative schedule for the public hearings for
this annexation and zoning request (if the necessary revisions are submitted in time for City staff
to review them) is as follows:
* Planning and Zoning Board: January 18, 2001
(Recommendation to City Council)
* Initiating Resolution, City Council: January 2, 2061
* First Reading, City Council: February 6, 2001
* Second Reading, City Council: February 20, 2001
* Effective Date of Annexation: March 2, 2001
6. Ken Waido of the Advance Planning Department offered the following comments:
a. This annexation request looks like it is trying to gain its c6ntiguity from the
Hearthfire property and development located across Richards Lake. Normally a
waterbody does not block contiguity, but the Annexation Plat leaves a lot of
questions unanswered regarding the possibility of intervening properties.
b. The property does not look like it is adjacent to Richards Lake. There appears to
be "land" between your property and the lake.
C. Valley View Road (or is it Richards Lake Road? In the County it may have both
names) also would not block contiguity. The City of Fort Collins typically should
not annex the road since it primarily serves County development.
d. However, at the extreme northern point of the property it looks like there is an
overlap with the road. Is Valley View Road actually a platted road? State law
requires the City to either annex the whole road ROW or none of the ROW. The
City cannot annex only part of a road ROW.
e. The legal description of the property is "Lot 27 of the Highland Place
Subdivision. Delete the references to "also known as Parcel Number 98254-13-
027".
f The requested UE — Urban Estate zoning is consistent with the City Plan Structure
Plan.
g. There is no need to show the Hearthfire PUD lots on the Annexation Plat. Please
remove them.
h. The Annexation Plat must show which part of your property boundary is being
used to satisfy the 1/6`h contiguity requirement.
Paul Eckman of the City Attorney's Office should be consulted on this proposal
to make sure that it meets the provisions of State law regarding annexation.

7. Craig Foreman of the Parks Planning Department stated that they have no concerns or
comments regarding this annexation and zoning request.
8. Paul Eckman of the City Attorney's Office stated that he has concerns regarding the 1/6"
contiguity requirement and missing information (acreage of the annexation) on the
Petition.

Dear Steven,
Staff has reviewed the Rice Homestead Annexation and Zoning documentation (including the
Petition and Annexation Plat) that was submitted to the City on November 6, 2000, and would
like to offer the following comments:
Roger Buffington of the Water/Wastewater Department stated that they have no
concerns or comments regarding this annexation and zoning request. Water and sanitary
sewer services for the property will be served by the East Larimer County Water District
and the Cherry Hills or Boxelder Sanitation District. Please contact the Districts directly
for their requirements.
2. Basil Hamdan of the Stormwater Utility stated that they have no concerns or comments
regarding this annexation and zoning request.
3. Ellen Switzer of the Light & Power Department stated that this area is currently
provided electric service by Poudre Valley Rural Electric Association (REA). The City of
Fort Collins will provide electric service to the property following annexation, per the
attached letter to the property owner. Poudre Valley REA service rights fees will apply to
all electric service after the Fort Collins Utilities Light & Power transfers electric service
and assumes responsibility for the electric service in the annexed area.
4. Dave Stringer of the Engineering Department stated that the property owner/applicant
must annex all of the Valley View Road right-of-way (ROW). Please see the attached
Annexation Plat with Engineering comments.
5. Jenny Nuckols of the Zoning Department stated that the Vicinity Map on the
Annexation Plat (Sheet 1 of 1) shows some incorrect zoning designations. These must be
corrected. Please see the red -lined copy of the plat.
