Be sure and return all red -lined plans when you submit the Final Compliance Plans. I don't believe this should be specified on the plat as I don't believe ownership and maintenance by the City is intended upon the recordation of the plat but at some point after. If it is intended to assign to the City upon recordation then it should be verified that the appropriate City signatures are obtained on the plat to properly assign this responsibility. [12/16/08] With the development being commercial, it seems odd to have Tract A be specified as being owned and maintained by an HOA. Please note that with the designation of Tract A as a blanket temporary construction easement, no building or structure can be placed within the tract. With Filing 2 presumably vacating the entire easement, this would then not be of concern. Please also note that by designating this tract as a "temporary construction easement" this easement is being dedicated to the City, which may or may not be intended. [12/16/08] All areas that are to be disturbed with this first phase, whether grading, topsoil removal, or stockpiling onto, should be part of a legally described tract or lot on the plat in order to have this area be defined as part of the approved PDP and specify that this certain area applies to the development agreement specific to the PDP. Page 3 -♦ Number: 123 Created: 2/4/2009 [2/4/09] Groundwater Report: Per Recommendation #7, page 22, the Development Agreement shall address the need for a monitoring well to assess the impacts of drawdown on the northern wetland. [12/19/08] The fence that is adjacent to the trail will extend along the wetland boundary in the buffer, in a location to be determined by the City's Environmental Planner. The fence shall be a minimum of 4 feet high, of an open character, with wire mesh on the bottom half. [12/19/08] In the location of the retaining wall in the south wetland adjacent to the built environment, the fence shall be a minimum of 6 feet high (similar to the fence along the Mason Trail next to the rail road) with wire mesh the full height of the fence. Number: 73 Created: 12/19/2008 [2/3/09] Add note to grading plan that the final grading for the edges of the wetland will be staked in the field by Steven Long (wetlands biologist) and the City of Fort Collins' Environmental Planner. [12/19/08] The new edge of the wetland adjacent to the retaining wall system is to have an irregular edge, not a straight line. The irregular edge will allow trees and shrubs to form a deeper transition into the wetland, and to eliminate the current "hedgerow" design. Page 2 ib �o STAFF PROJECT REVIEW City of Fort Collins BHA Design Date: *2/9/2009 C/o David Kasprzak 1603 Oakridge Drive Fort Collins, CO 80525 Staff has reviewed your revisions re -submittal for NORTH COLLEGE MARKETPLACE, WETLANDS PROJECT DEVELOPMENT PLAN (PDP) - TYPE 1, and we offer the following comments: ISSUES: Department: Current Planning Issue Contact: Dana Leavitt Topic: General Number: 45 Created: 12/19/2008 [2/3/09] The findings on page twelve of the report are to be evaluated by Steven Long (wetlands biologist) with recommendations to offset the potential impacts of any drawdown. [12/19/08] The ground water study does not address the potential impacts as raised previously. This report shall address any impacts to either wetland. Number: 47 Created: 12/19/2008 [2/3/09] Written documentation will be required as referenced in paragraph 3, page 21 of the report. This can be addressed during the final review of the project. [12/19/08] The under drain dewatering system will be taking groundwater and converting it to surface water. Once the water is converted to surface water evapotranspiration occurs and the issue of augmentations arises. As the under drain water will be draining into the wetlands, which will be public property, provide information (dewatering plan) that the evapotranspiration will not create a loss of legally established water rights.
