Allen,
In my letter to you yesterday regarding the Chick-Fil-A proposal I forgot to reiterate staffs concern about the location of
trash enclosure in the parking lot along South College Avenue. It would appear, from the conceptual plan, that the back of the
trash enclosure would be only about 10' to 12' away from the public sidewalk along South College Avenue. As set forth in
Section 3.5.l(I)(1) of the City's Land Use Code, no areas for trash collection or compaction shall be located within 20' of any
public street or public sidewalk. For the trash enclosure to remain in the proposed location a request for a Modification of
Standard would have to be submitted for review and decision by the Planning & Zoning Board.
Also, to be more clear on how much additional street right-of-way (ROW) would be needed for West Horsetooth Road along
the north side of your property, the existing subdivision plat of record for the shopping center is the Replat of Lots 1, 2, 3 & 4
- Creger Plaza Subdivision, which shows a 50.0 F half ROW in this location. At conceptual review on August 4, 2008, the
Engineering Department indicated that a total of 57.5' of ROW is needed from the centerline of West Horsetooth Road, being
a 4-lane arterial street. This would mean that an additional 7.4' of ROW is absolutely needed, which would be in addition to
the 12' needed if the City determines that an eastbound right -turn lane on Horsetooth Road is absolutely necessary. Therefore,
the north side of your property could be affected in the amount of 19.4' for additional ROW. This again brings up the
question of how much property in the Cottonwood Shopping Center do you own and/or control? Are you able to shift the
proposed drive-in restaurant to the south far enough to allow for the needed street ROW, knowing that this results in a loss of
parking in the shopping center.
