I conferred with Joe Olson and Mike Herzig as well. Joe indicated a quick look at the mobility characteristics before and after a right turn lane showed negligible improvement. Mike indicated the right turn lane project was never advanced due to obvious funding constraints with the irrigation ditch. The four lane section of Horsetooth appears to be adequate as constructed and I cannot foresee a time that reconstruction of this roadway would be warranted. I am recommending that we drop our request for the additional 7.5 feet of right of way as well as the dedication of the 12 feet needed for a turn lane. The redevelopment of this site from its current use to that of a Chick Filet appears to be reasonable and will not deleteriously impact the current roadway network. Is it a Type I or II review? If it's a Type II review, can that be done before a zoning officer at an administrative hearing or do we have to go before P & Z? 2. Will a ROW be required? If so, how much and what triggers the request? Depending on the ROW decision, does the code require us to prepare a traffic study? 3. What, if any, extraordinary street and sidewalk improvements will be required? Of course we will repair any damage caused by our construction. 4. How to resolve the various setback issues. 5. Chick's main entrance will face south toward the parking lot as Chick would not be willing to have the entrance conflict with the drive-thru lane. How do we resolve this comment? 6. Ideas for satisfying this condition given the building orientation. 7. Do the elevations we shared of Chick's building generally accomplish this objection subject to specific detail review? 8. I apologize for not fully expressing why I suggested waiting until the end of next week for a reply. I thought that would give you and the staff the time to prepare a more thorough response, as opposed to an isolated answer on the ROW. Time is crucial, but I also need to demonstrate we are making progress on all the issues required for approval, so I set the deadline later with this in mind. BHA can meet with the staff again before the end of next week to work through details if that would be helpful. I'm not asking for a final conclusion, just significant progress and clarity. If this is unrealistic, then I would like to know the answer on the ROW by the end of this week and when you could send a more comprehensive reply to the rest of the items in Steve's letter. Let me explain what I was thinking when you asked when I needed a reply from staff, or really what I would like the reply to contain. I'm looking for clarity and certainty to the extent open items can be resolved. Ideally I need to give a letter from the City to Chick to demonstrate we are making progress. So when I said the end of next week would be OK, what I am looking for is an updated copy of the letter Steve sent on 9/10 by then. While additional right-of-way dedication would be needed to construct ultimate improvements to meet the current Larimer County Urban Area Street Standards and a dedicated right turn lane may have some benefit at this intersection, City Staff has determined through site inspection, plan review and preliminary traffic modeling that the cost to construct this widening and right turn lane improvements would be very high and would not likely yield significant benefits to the functionality of this intersection. It is not likely that a project to widen Horsetooth and construct a dedicated right turn lane would be considered at this location in the foreseeable future. Based on time findings, the City has determined that this proposed restaurant development will not be required to dedicate any additional right-of-way on Horsetooth. However, if the site could be designed such that the City could ultimately obtain the necessary right-of-way and funding needed to construct a dedicated right turn lane it would be beneficial to the overall traffic flow in the area. As I indicated to you last week, our position is that our previous request for right of way dedication is no longer being required for your proposed redevelopment of the old Nate's site into a Chick Filet. I spoke with Steve Olt earlier today --he will be sending you a letter tomorrow that covers all of the information you requested in your email. I thought it prudent that I write you this letter so that you had formal documentation of our position on the right of way dedication. Please call or email me if I can be of assistance.
