To my knowledge, there is no LUC requirement for having this "passing" lane around the outside of the
pumping station. In fact, just the other day I was filling up at the Safeway fueling station on Harmony Rd.
and noticed their outside fueling station lane was only wide enough for one vehicle. We have discussed it
in depth in Steve's presence and I have never heard any objection. We better wait for Steve to reply when
he gets back though.

This project is in development review right now and Steve is the planner on the project. He is out of town
til Thursday. On first blush this seems like a revokable right-of-way encroachment permit to me, unless
that outer lane helps the project to meet some development criteria in the LUC. Not being familiar with the
specifics of the project, I couldn't answer that question. Hopefully it can wait til Thursday!

Hello Paul,
The King Soopers on Taft Hill & Elizabeth purchased the old gas station at this intersection. They want to
rebuild with a new King Soopers fueling station but their "cookie cutter" fueling station layout doesn't fit
entirely within the site after they dedicate the new ROW the City needs for future widening. They want
permission to use the ROW in the interim condition until the street is eventually widened out. There would
not be any structures in the ROW, only concrete pavement and landscaping. Once the street widening
occurs they would essentially lose a lane for passing around the outer most pump station which they are
OK with. What I need help with is figuring out what is the best way to grant permission to use this ROW in
the interim condition ? Revockable encroachment permit, license agreement etc...
