with only a temporary construction easement and is pretty adamant at this point that he is unwilling to
provide a permanent easement.
I can see George's point of view - that the 20' easement is really required to ensure installation access
since the water line will be located in the center of the easement. Given the requested 5' addition will be
granted to the city of Fort Collins for the expansion of Timberline Road when George's property is
developed, it would seem that George's temporary construction easement would be sufficient for
purposes of installing the water line with the actual dedication coming upon development of his
property.
Shelby Sommer. the city planner assigned to this project, is willing to accept this letter of intent from
George Holier only if ELCO sends her confirmation that this is acceptable.
If you are willing to accept a temporary construction easement for this project, would you please send
Shelby Sommer's an email confirming this? If you have questions, please give me a call on my cell

In regards to the Liberty Farms development, the additional five feet of construction easement on the east side of the existing
permanent ELCO waterline easement, as indicated in George Holter's letter of intent, is acceptable.
Additionally, if the information is necessary, the size of the proposed waterline is 8" rather than 12."

Mike,
I'm the planner on the Liberty Farms project, working with Jade Miller of DMW. Liberty Farms is
located on the east side of Timberline Road, north of Vine Drive. I am trying to tie up some loose ends
to remain on the city of Fort Collins Planning and Zoning board hearing for Dec 6. If I can't tie these
loose ends up by tomorrow (Wed) I will be bumped to their Jan 17 hearing.
One of the items is a requirement to provide a letter of intent by George Holter to grant an additional 5'
easement on the east side of Timberline for upgrading the ELCO water line from 2" to a 12" line. I
believe George has been in contact with ELCO, not sure if he's talked to you or not. George's property
is adjacent to the ELCO easement along Timberline. The current use of the property is agricultural.
George's assertion is that given the land is agricultural; all the ELCO should require is a temporary
construction easement. His letter of intent is attached. George has assured me that ELCO will be fine
