Re: Liberty Farms Off -Site Sanitary Sewer — Railroad Crossing Permit
Dear Randy,
The above -referenced project representatives have recently contacted me regarding a railroad
crossing permit for the Burlington Northern Sante Fe (BNSF) railroad that the project's off -site sanitary
sewer will need to cross along Vine Drive. You and I spoke on the telephone last Friday, 22 February
2008 regarding what I understand to be the City of Ft. Collins (City) requirement that this permit be in
place before the City would grant the project approval. This letter seeks to document the conclusion of
our discussion being that for this specific situation, the permit to cross the railroad will not be required
at this time. Reasons for that being:
1. License Agreement Would Expire Before Construction: My reading of BNSF's license agreement
requires that the infrastructure (i.e. the sanitary sewer crossing of the railroad) be installed within one
year of when to permit is granted, else the permit is voided. Due to the fact that an off -site sewer of
over 1-mile in length, that has yet to be designed and approved, would have to be in place before this
crossing could be connected to sanitary sewer service, it is doubtful that the crossing would be
constructed before the permit expired. The permit cost is $2500 and this fee would be unnecessarily
spent if this occurred. The District fully anticipates working with the developer and the railroad to
acquire the necessary permits to make this crossing when the timing is appropriate.
2. Insurance Coverage: If the crossing agreement were to be completed today, before the line would
be installed and placed into service, the District would be required (per BNSF's license agreement) to
place this crossing within its liability insurance coverage package. There would be a cost associated
with this for which the District would not be realizing a just method of cost recovery (i.e. no sanitary
sewer taps connected to the line, no payment of sewer fees to the District from the beneficiaries of the
line, from which the District's sewer fees generate revenue).

property owners.
3. Please discuss how in the future the pond can be retro fitted to.discharge into
the proposed drainage channel to the east. It is suggested that either an
easement is acquired to drain the pond to the east, or provide a retention
pond in an interim condition until future downstream improvements are
constructed.
4. At final a ditch crossing agreement will be needed.
5. For erosion control maybe a perimeter temporary ditch on the south end of
the site along the canal might prevent silt from entering the irrigation canal.

[2/25/08] Based on discussion with the City Pavement Management Director, the
concrete road section proposed on Chenyhurst should extend and connect to the
concrete roundabout. Because it is an arterial roadway, it is not preferred to have
several concrete to asphalt transitions. Asphalt and concrete costs are almost the
same based on new cost data provided to the City.

Please refer to LCUASS 7.4.1(8) for off -site design requirements. There will likely be
medians and turn lanes into the site with the ultimate design. The ultimate cross
sections should show how the crown of the road will be constructed with respect to
the median locations.

thoroughly loosened to a depth of not less than 8 inches and soil amendment

of at least 6 inches by tilling, disking or other suitable method, at a rate of at
least 3 cubic yards of soil amendment per 1,000 square feet of landscape area.
A permit must be obtained from the City forester before any trees or shrubs as
noted on this plan are planted, pruned or removed on the public right-of-way.
This includes zones between the sidewalk and curb, medians and other city
property. This permit shall approve the location and species to be planted.
Failure to obtain this permit may result in replacing or relocating trees and a
hold on certificate of occupancy.
The developer shall contact the City forester to inspect all street tree plantings
at the completion of each phase of the development. All trees need to have
been installed as shown on the landscape plan. Approval of street tree planting
is required before final approval of each phase. Failure to obtain approval by
the City forester for street trees in a phase shall result in a hold on certificate of
occupancy for future phases of the development."
