Subject: Collinwood Personal Services Building
Steve and Ted,
We are currently working on the Collinwood project along with Jim Nakai of James W. Nakai &
Associates, P.C. for Bethesda Real Estate Company. Currently a 33,000 SF personal services building is
proposed near the intersection of Lemay Ave and Rule Drive. It is my understanding that the project has
gone through a couple of conceptual reviews in some form or another and that Nakai associates has
discussed general layouts with your office. Previous iferations included residential units which have been
removed.
We had a question regarding general layout. The previous masterplan and previous concept plans that
have been presented have depicted the building setback from the street with parking in between. This
layout basically mimics the existing development in the immediate area. We have not been involved in the
past conceptual reviews or conversations, but it is our understanding that this general layout intent is
something the City may accept for this project although it is not the norm. We just wanted to verify this
design assumption and make sure we were heading in the right direction and on the same page.
We have attached the current layout, the layout that was presented at the last conceptual review and the
previously approved masterplan for your convenience. J 7' f4car

Joe,
Attached is the City staff comment letter from the September 12, 2005, Conceptual Review. This proposal
was for 34 condo dwelling units and a 19,000 square foot personal services building. Your understanding
that City staff may accept a general layout with parking between the personal services (non-residential)
building and the street is not supported by staff. On page 10 of the staff comment letter, the 4th comment
under Comment #10 - Current Planning it states:
* Section 3.5.3 - Mixed -Use, Institutional and Commercial Buildings of the LUC sets forth
requirements for:
- Relationship of Buildings to Streets, Walkways and Parking
- Variation in Massing
- Character and Image
Section 3.5.3(B)(2) of the Land Use Code (LUC) sets forth the requirement that build -to lines based on a
consistent relationship of buildings to the street sidewalk shall be established in order to form visually
continuous, pedestrian -oriented streetfronts with no vehicle use area between building faces and the
street. Further, in this section there are requirements that the building shall be located no more than 15'
from the street right-of-way for Rule Drive (smaller than a full arterial street) and/or at least 10' and no
more than 25' from the street right-of-way for South Lemay Avenue (larger than a two-lane arterial street)
These are standards that can be modified through the Modification of Standard process set forth in
Section 2.8.2 of the LUC; however, to date City staff has not discussed with an applicant about or
indicated support for modifying the standard to allow a building to be set back further than allowed and
provide parking in front, along the streets.
