Can these hours be mitigated to give the neighborhood a rest? We are dreading the large delivery trucks beeping away as they back to loading docks. This and the sound of dumpster lids crashing down in the night can travel huge distances on a still night with the windows open. Will there be restricted hours of delivery? Quiet zones and hours? Are there any protections? These concerns have been raised before but not answered. ' from the minutes of the Planning & Zoning Board public hearing on May 21, 2009 ... - (page 20) Eric Holsapple, the developer, said that the King Soopers store in North College Marketplace will have a trash compactor so it's not going to have the banging lid that might be irritating to neighbors. 5. Regarding restricted hours of delivery, quiet zones and hours, and any protections * As previously stated in Responses 3 & 4 by the developer and applicant, above, there are no specific hours of delivery; however, large delivery trucks rarely come to the King Soopers store at late evening or early morning hours. In some areas of town there are places called quiet zones where signs are up relative to truck back up beepers - they turn the trucks off versus having them run, especially in the middle of the night. Mr. Holsapple, the developer, said there will be beepers when they back up; however, the big trucks mostly don't come in the middle of the night. To date there has not been any stated position by the developer or King Soopers that this supermarket would be open 24 hours a day. * During the Planning & Zoning Board's discussion and deliberation of the North College Marketplace, Project Development Plan (PDP) there were several questions asked by Board members about potential 24 hour noise, the impact of truck back up beepers on neighborhoods, and potential noise from banging trash dumpsters. The developer and applicant responded to and answered these questions to the Board's satisfaction at the public hearing and the Board apparently had no reason to condition the approval of the PDP. I am providing you with a hard copy of this message along with the notes from the August 7, 2008 neighborhood meeting and the minutes from the May 21, 2009 Planning & Zoning Board public hearing. The King Soopers store at North College Marketplace is proposed to be 123,000 square feet in size. Although this store would be about 60,000 square feet larger than most to date it is questionable as to whether or not it can be defined as a "mega store", which is defined as a million times greater. 2. Nowhere is it stated that the King Soopers store will be open 24/7. That intent has not been expressed at the neighborhood meeting held on August 7, 2008, in the applicant's Statement of Planning Objectives, on the Site Plan that went to the Planning & Zoning Board on May 21, 2009, or in the Board's minutes from their May 21st public hearing. King Soopers intended hours of operation can be further discussed during their Final Plan review. It is possible that the hours can be mitigated to address the neighbors concerns. 3. Regarding large delivery trucks beeping away as they back to loading docks ... * at the neighborhood meeting on August 7, 2008 there were 3 comments/questions expressed relating to this topic. - page 3, Comment 9) "We live in the Pheasant Ridge development to the east and north and are most concerned about noise, especially the 24 hour noise." Applicant's response: "That is a valid concern. King Soopers will control the times of the day for trucks to the site for deliveries." - page 3, Question 10) "How high are the screening walls along the east side of the King Soopers store to screen the trucks?" Applicant's answer: "They will be 14 feet high." The 14 foot wall height will help mitigate truck noise, including the beeping while backing up. - page 3, Comment 11) "1 live close to where the trucks will be entering the site along the east side of the King Soopers store. I am concerned about the noise." Applicant's response: "As previously stated, King Soopers will control truck deliveries and will do what they can to minimize the noise." * from the minutes of the Planning & Zoning Board public hearing on May 21, 2009 ... - (page 8) Member Lingle noted that there are 2 loading docks on the east side of King Soopers. It looks like both have a masonry screened wall. Mike Mulhern, the developer's consultant, said with regard to screening there are 2 screen walls. Chair Schmidt asked how big the brick walls would be. Mr. Mulhern said the estate brick walls would be 14 feet high. - (page 9) Member Carpenter noted in the neighborhood meeting notes there was a concern raised on the 24 hour noise. The answer noted that King Soopers will control the times of day for truck and site deliveries. She asked what those times would be and how they would be enforced. Mike Mulhern said that he doesn't have that information tonight and would have to get back to the Board. Mr. Mulhern did say that he knows that King Soopers has to abide by State laws that have 2 different restrictions for noise for daytime and nighttime hours. They will work with their neighbors to make sure they operate within those restrictions. - (page 20) Chair Schmidt asked about the loading dock and the compatibility with the neighborhood, will the beepers be going off 24 hours a day? Developer Eric Holsapple said a comment at the neighborhood meeting was with regard to someone who hears trash pickup behind the Albertson's store. There is 300 feet to the nearest structure at the mobile home park and with the elevation difference of 12 - 14 feet, a ditch and other things (such as extensive vegetation), he doesn't think it'll be an issue at North College Marketplace. - (page 20) Eric Holsapple, the developer, said they have a King Soopers center in Loveland and there is delivery traffic throughout the day.
