However if they are using the detention ponds as planned they will either need to become part of the HOA or work out an agreement to pay their prorated share of the maintenance. The other option is to build detention on their site separate from the HOA ponds. There still might be an impact if the HOA ponds are the only outfall. Routing through the HOA ponds would be much less impact or the outfall of the onsite ponds could be piped around the HOA ponds to the outlet pipes. This all looks pretty normal to me. The issue is that Tracts T and N are not in the HOA, but according to the 3rd Filing Drainage Report can/need to drain to these ponds. I was mistaken when I told Steve Dush that this was in the development agreement. If you need any other documentation, please let Marc and I know.
