Compliance with Article 3 of the Land Use Code — General Development Standards The proposed subdivision plat complies with all applicable sections of Article 3 of the Land Use Code. Vehicular access continues to be provided to the adjacent streets. The applicant has provided all necessary easements to serve the property. The subdivision plat reflects dedication of a 25 foot wide emergency access easement and existing easements for the New Mercer Ditch and transportation facilities have been retained. As a point of clarification, the Hearing Officer has added a condition to this approval, requiring the applicant to amend the plat to accurately reflect existence of the New Mercer Ditch easement. SUMMARY OF CONCLUSIONS A. The Tolmar Subdivision (Expansion of Building) Project Development Plan is subject to administrative review and the requirements of the Land Use Code (LUC). B. The Tolmar Subdivision (Expansion of Building) Project Development Plan complies with all applicable General Development Standards contained in Article 3 of the Land Use Code. DECISION The Tolmar Subdivision (Expansion of Building) Project Development Plan #38-07, is hereby approved by the Hearing Officer subject to the following condition: The Applicant shall revise the subdivision plat to reflect the existing New Mercer ditch easement prior to plat map recordation. Site Context/Background Information The surrounding zoning and land uses are as follows: N: E; existing educational use (National Technological University in the Centre for Advanced Technology) S: E; existing and planned offices (Market Center Office Park in the Centre for Advanced Technology) E: E; existing offices (Centre Tech in the Centre for Advanced Technology) W: NC; existing healthcare and retail (Columbine 90-Bed Rehab. Facility and various businesses) The property was annexed in September, 1965 as part of the Fourth College Annexation. The property is a part of the Center for Advanced Technology Overall Development Plan (ODP) that was approved by the Planning and Zoning Board in September, 1983 for "high tech" uses. There have been 3 subsequent amendments to the ODP, each showing this parcel to be industrial/office/R&D uses. The northerly 2/3 of the property (5.0 acres) was platted in March, 1988, and replatted in January, 1993, as the Centre for Advanced Technology, Eight Filing. The entire property (7.71 acres) was platted as Atrix Laboratories in May, 2002. It was approved for 57,184 square feet of office & industrial uses in one 1- and 2- story building. A minor amendment is being evaluated in a parallel process to the plat request. 2. Compliance with Article 4 and the E-Employment Zoning District Standards: There are no standards contained within Article 4 that are applicable to the requested replat. PUBLIC HEARING The Hearing Officer, presiding pursuant to the Fort Collins Land Use Code, opened the hearing at approximately 3:30 p.m. on February 4, 2008 in Conference Room B at 281 N. College Avenue, Fort Collins, Colorado. HEARING TESTIMONY, WRITTEN COMMENTS AND OTHER EVIDENCE: The Hearing Officer accepted during the hearing the following evidence: (1) Planning Department Staff Report; (2) application, plans, maps and other supporting documents submitted by the applicant and the applicant's representatives to the City of Fort Collins; and (3) a tape recording of the hearing. The LUC, the City's Comprehensive Plan (City Plan), and the formally promulgated policies of the City are all considered part of the evidence considered by the Hearing Officer.
