This is a request for an extension of the approval for the above project. it has been
approved by the Planning & Zoning Commission on January 30, 2008.
Due to changes in commercial market conditions and difficulties obtaining eommenial
loans we need more time to redesign the project.

Dear Ms. Siek,
The City of Fort Collins has reviewed and approved your request for a six (6) month
extension to the Hellenic Plaza, Major Amendment, originally approved on January 15,
2009. Based on this extension, a Final Plan in accordance with the City of Fort Collins
Land Use Code must be received, reviewed, and approved no later than July 15, 2012.
Please note that the code does not authorize further extensions and failure to receive
Final Plan approval by July 15, 2012, will render the Hellenic Plaza, Major Amendment
null and void.

Barbara,
Attached is the approval letter for your request for a 6-month extension of the Planning &
Zoning Board's approval (of January 15, 2009) of the Hellenic Plaza, Major Amendment - File
#41-08, which would expire on January 15, 2012 without an extension. As stated in the letter,
you must attain "final" annroval of the development plans no later than Julv 15.2012 or the
plans will expire and become null & void. At the time of final approval mylars of the plans will
be filed in Technical Services in the City, thereby vesting the development plans for a period of 3
years.
As set forth in Section 2.2.11(13)(3) Term of Vested Right in the Land Use Code, within a
maximum of three (3) years following the approval of a final plan the applicant must undertake,
install and complete all engineering improvements (i.e.: water, sewer, streets, curb, gutter, street
lights, fire hydrants, storm drainage, etc.) in accordance with City codes, rules and regulations.
Once the final development plans are approved and filed an applicant is entitled to request
extensions, if and when necessary, as set forth in Section 2.2.11(D)(4) of the Land Use Code.
As a reminder, the Hellenic Plaza, Major Amendment is the plan where you converted 9
retail units on the first floor of the building to 7 additional 2-bedroom residential dwelling
units. This plan, when approved by the Planning & Zoning Board on January 15, 2009,
superseded the previous development plan. The City's Land Use Code allows only one plan to
be in effect on any property at any given time.
