OF THE COUNCIL OF THE CITY OF
FORT COLLINS AUTHORIZING THE CITY OF
FORT COLLINS TO ENTER INTO AN AGREEMENT
WITH THE UNION PACIFIC RAILROAD
COMPANY FOR PERMISSION TO CROSS THE
RAILROAD COMPANY'S RIGHT-OF-WAY
FOR THE INSTALLATION OF ELECTRIC SERVICE
WHEREAS, the Union Pacific Railroad Company has tendered to the City
of Fort Collins an agreement covering the construction, maintenance and
operation of an underground power-wire line across the property and under
the track of the railroad company in the vicinity of Horsetooth and Timber-
line Roads for the purpose of providing electric service to the Collindale
Industrial Park, and
WHEREAS, in the considered opinion of the Council of the City of Fort
Collins, the best interest of the City will be advanced by the acceptance
of said agreement
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT
COLLINS as follows
Section 1 That the terms of the agreement submitted by the Union
Pacific Railroad Company,a true copy of which is attached hereto as Exhibit
°A," be, and the same hereby are, accepted on behalf of said City
Section 2 That the City Manager of the City of Fort Collins be,
and he hereby is, authorized and directed to execute said agreement on
behalf of the City of Fort Collins
Passed and adopted at regular meeting this 6th day of February
