HomeMy WebLinkAbout1979-054-06/05/1979-ADOPTING THE REPORT OF THE CITY ENGINEER ON THE ESTIMATES, COST, AND ASSESSMENTS FOR CONSOLIDATED ST r RESOLUTION 79-54 OF THE COUNCIL OF THE CITY OF FORT COLLINS ADOPTING THE REPORT OF THE CITY ENGINEER ON THE ESTIMATES, COSTS, AND ASSESSMENTS FOR CONSOLIDATED STREET IMPROVEMENT DISTRICT NO 74 APPROVING THE THE DETAILS AND SPECIFICATIONS FOR SUCH PROPOSED DISTRICT, DETERMINING THE AMOUNT OR PROPORTION OF THE TOTAL COST TO BE PAID BY A METHOD OTHER THAN ASSESSMENTS AGAINST PROPERTY IN THE DISTRICT, THE NUMBER OF INSTALLMENTS AND THE TIME WITHIN WHICH THE COST OF THE IMPROVEMENTS ASSESSED AGAINST PROPERTY IN THE DISTRICT WILL BE PAYABLE, THE RATE OF INTEREST TO BE CHARGED ON UNPAID INSTALLMENTS, THE PROPERTY TO BE ASSESSED FOR THE IMPROVEMENTS, THE METHOD OF MAKING SUCH ASSESSMENTS, AND THE DATE WHEN THE COUNCIL WILL HOLD A HEARING AND CONSIDER THE ORDERING BY ORDINANCE OF THE PROPOSED IMPROVEMENTS WHEREAS, heretofore, the City Council by resolution directed the City Engineer to make a complete survey of proposed Consolidated Street Improve- ment District No 74, including the preparation of a map, plans, speci- fications, and estimate of cost of the improvements in said proposed district; and WHEREAS, the City Engineer has made his report and has presented the details and specifications for the proposed district. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS Section 1 That the report, plans, specifications, map, and estimate as presented by the City Engineer for said district be, and the same hereby are, accepted and approved Section 2 That the following amount or proportion of the total cost of such improvement shall be paid by the City at large and not by assess- ments against property in the district, to-wit Mulberry Street Improvements 53% ± 5% Drake Road Improvements 34% ± 5% Section 3 That the property to be assessed for the improvement shall be as follows West Mulberry Street Improvements The south side of West Mulberry Street between Crestmore Place and Tyler Street and the north side of West Mulberry Street between Taft Hill Road and the City boundary west of Tyler Street Drake Road Improvements The north side of Drake Road from Yorktown Drive to a point approximately five hundred seventy-seven (577) east of Yorktown Drive A portion of the total cost of such improvements shall be paid by the City at large and not by assessments against the property in the district. Section 4 That assessments for the cost of installing the improve- ments in the district will be made as follows. All street improvement costs, except those to be paid by the City at large, shall be assessed upon all the lots and lands abutting on the streets improved in proportion as the frontage of each lot or tract of land is to the frontage of all lots and lands so improved Section 5. That said assessment shall be payable in ten (10) equal annual installments with interest on the unpaid installments at the rate of ten percent (10%) per annum Section 6 That the assessments shall be made in the following manner Upon the completion of the improvements and their acceptance by the City Council , the City Engineer shall prepare a statement showing whole cost of the improvement, together with incidental costs associated therewith and shall cause to be prepared an assessment role which shall contain the names of the last known owners of the property to be as- sessed, a description of each property to be assessed, and the amount of the assessment of each property The City Clerk shall notify the owners of all property to be assessed specifying the whole cost of the improvements and the proportion to be paid by the City The assessment role shall be on file in the City Clerk' s office The City Council shall hear and determine any complaints or objec- tions which may be made in writing by any of the owners of the property to be assessed Thereafter, an assessing ordinance shall be passed by the City Council assessing the cost of the improvement against the property to be assessed in the proportion finally determined -2- Section 7 That the 17th day of July, 1979, at the hour of 5:30 p m or as soon thereafter as the matter may come on for hearing in the Council Chambers, City Hall, City of Fort Collins, Colorado, is the date on which the Council of the City of Fort Collins will consider the ordering by ordinance of the proposed improvements and hear all complaints and objec- tions that may be made and filed in writing concerning the proposed im- provements by the owners of any real estate to be assessed or any persons interested generally Section 8. That the City Clerk be, and she hereby is, directed to give notice by publication and mailing to owners of property to be assessed and to all interested persons generally, all as set forth in Chapter 16 of the Code of the City of Fort Collins Passed and adopted on a regular meeting of the City Council held this 5th day of June, A D 1979 7 T• Mayor C er -3- M • NOTICE TO Owners of property to be assessed in Consolidated Street Improvement District No 74 and to all interested persons of the kinds of improve- ments proposed, the number of installments, the time in which the cost of such improvements will be payable, the rate of interest to be paid on unpaid and deferred installments, the extent of the district to be improved, the probable cost and the maximum cost to be assessed, the time when the City Council will consider ordering by ordinance the proposed improvements and hear complaints and objections, and that a map of the district and details concerning the same are on file and can be seen in the City Clerk's office PUBLIC NOTICE is hereby given to persons interested and to owners of property to be assessed in Consolidated Street Improvement District No 74 that the kind of improvements proposed for said district and their extent is as follows West Mulberry Street Improvements Location West Mulberry Street from Crestmore Place to a point approximately three hundred seventy-five (375) feet west of Tyler Street Improvements Street improvements including pavement, curb and gutter, sidewalk, street light- ing, traffic signal, and drainage facili- ties Necessity These improvements are necessary because the existing road surface on West Mul- berry Street has deteriorated seriously and has totally disintegrated in portions requiring that the roadway be completely reconstructed Additionally, the lack of curb and gutter, sidewalk, and street lighting on said street is a serious safety hazard for pedestrians and bikers Drainage facilities are necessary to prevent similar type deterioration in the future The traffic signal is necessary to control traffic at the intersection of West Mulberry and Taft Hill Road Drake Road Improvements Location West Drake Road from Yorktown Drive to a point approximately five hundred seventy- seven (577) feet east of Yorktown Drive Improvements Street improvements, including pavement, curb and gutter, sidewalk, and street lighting Necessity These improvements are needed to bring this portion of Drake Road completely up to arterial street standards and to eliminate a safety hazards for pedes- trians, bikers, and motorists And that the probable cost of said improvements as shown by the total estimate of the City Engineer is THREE HUNDRED FIFTY-ONE THOUSAND SIX HUNDRED FORTY-TWO DOLLARS ($351,642) exclusive of the cost of collection, legal, advertising, engineering, financing, interest, and other inciden- tals, and that to said cost will be added an amount equal to twenty percent (20%) of such cost to cover the expense of collection, legal, advertising, engineering, financing, interest during construction, and other incidentals; and that assessments for the cost of such improvements within the district shall be made as follows All street improvement costs, except those to be paid by the City at large, shall be assessed upon all the lots and lands abutting on the streets improved in proportion as the frontage of each lot or tract of land is to the frontage of all lots and lands so improved And that the maximum cost to be assessed exclusive of the cost of legal, collection, advertising, engineering, financing, interest during construction, and other incidentals is as follows ONE HUNDRED FIFTY-NINE THOUSAND ONE HUNDRED FORTY DOLLARS ($159,140) And that this assessment shall be made as follows Mulberry Street Improvements $32 38 per abutting front foot for street improvement cost* Drake Road Improvements $35 04 per abutting front foot for street improvement cost* * Said figure to include the cost of legal, collecting, advertising, engineering, financing, interest during construction, and other incidentals -2- 1 � r And that the 17th day of July, 1979, at the hour of 5 30 p.m. or as soon thereafter as the matter may come on for hearing in the Council Chambers of City Hall, City of Fort Collins, Colorado, is the date that the City Council will consider the ordering by ordinance of the proposed improvements and hear all complaints and objections that may be made and filed in writing by the owners of any property to be assessed or persons interested generally. All complaints or objections should be made in writing and filed in the office of the City Clerk to the City Hall before said date. A map of the district and estimates of cost schedule showing the approximate amount to be assessed upon the several lots or parcels of land within the district and all proceedings of the City Council in the premises are on file and can be seen and examined in the City Clerk's office during business hours at any time before said hearing.
