HomeMy WebLinkAbout1971-079-08/19/1971-APPROVING AN AGREEMENT WITH THE BOARD OF COMMISSIONERS OF LARIMER COUNTY CONCERNING THE RELATION OF RESOLUTION 71-79 OF THE COUNCIL OF THE CITY OF FORT COLLINS APPROVING AN AGREEMENT WITH THE BOARD OF COMMISSIONERS OF LARIMER COUNTY CONCERNING THE RELATION OF USE TAX UPON LICENSING OF MOTOR VEHICLES WHEREAS the City of Fort Collins has heretofore adopted a sales and use tax and WHEREAS the laws of the State of Colorado now authorize the collection by County Clerks of municipal sales and use taxes ,n connection with the licensing of motor vehicles and WHEREAS an agreement has been negotiated between The Board of County Commissioners of Lar,mer County and The City of Fort Collins which agreement pro- vides for the collection by the County Clerk of city sales and use tax ,n connection with the licensing and titling of motor vehicles and WHEREAS, said agreement has been approved by the City Manager and the City Attorney NOW THEREFORE BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS that the terms and conditions of said agreement be and the same hereby are accepted and approved and BE IT FURTHER RESOLVED that the Mayor and City Clerk be and they here- by are authorized and directed to execute said agreement for and on behalf of the City of Fort Collins 1911 Passed and adopted at a regular meeting of the City Council held this rit day of August A D 1971 yor ATTEST c,ty eyX ti AGREEMENT THIS AGREEMENT is made and entered into this day of A D 1971 , by and between THE CITY OF FORT COLLINS COLORADO a municipal corporation, hereinafter designated as City and THE BOARD OF COUNTY COMMISSIONERS OF LARIMER COUNTY COLORADO hereinafter designated as County WITNESSETH WHEREAS the City has by ordinance (Sections 8-49 through 8-137 inclusive of the Code of Ordinances of the City of Fort Collins Colorado 1958 as amended) adopted a sales and use tax and WHEREAS said tax is applicable to motor vehicle and other vehicles including trailers and mobile homes purchased in the City or used in the City by a resident thereof all as more fully set forth in the ordinance above referred to a copy of which has been furnished to the County and WHEREAS the City desires to use the services of the County Clerk and Recorder to collect the sales and use tax due to the City on vehicles registered with the County Clerk and Recorder for use by city residents in the City and Senate Bill 71 enacted by the General Assembly of the State of Colorado in 1971 provides for the collection of such tax by a County Clerk NOW THEREFORE in consideration of the premises and the terms of the within Agreement it is agreed as follows 1 The County Clerk and Recorder of Larimer County will collect for the City sales and use tax due under the ordinances of the City at the time a vehicle is registered by a resident of the City In the event such sales or use tax has already been paid and a receipt therefor is presented to the County Clerk and Recorder, then such tax will not be again collected by the County Clerk and Recorder The City has certified to the County Clerk and Recorder a true copy of its current applicable Sales Tax Ordinance and shall certify any subsequent changes therein to the County Clerk and Recorder and the County Clerk and Recorder shall be responsible only for the collection of sales tax as indicated in such ordinances as are so certified to him 2 The County Clerk and Recorder will remit to the City all sales and use tax collected on behalf of the City on a monthly basis and no later than the loth day of the following month 3 The City agrees to pay to the County an amount equal to five per cent (5%) of the total taxes for the City collected through the office of the County Clerk and Recorder which amount shall be paid by the City to the County within ten (10) days of receipt by the City of any such collec- tions 4 The City agrees to make available to the County Clerk and Re- corder all forms necessary for processing the collection of sales and use tax on behalf of the City 5 The County Clerk and Recorder shall keep such records as may be necessary to disclose the amount of tax collected for the City and such records shall be open to the City at all normal business hours 6 This agreement shall continue until terminated by either party it being specifically understood and agreed that either party hereto may can- cel and terminate the within agreement upon giving to the other party thirty (30) days written notice of intent to terminate this agreement 7 This agreement shall be effective on July 1 1971 and the County Clerk shall collect taxes for the City pursuant to this agreement com- mencing on such date BOARD OF COUNTY COMMISSIONERS OF LARIMER COUNTY APPROVED By Cnalrman County Cler an Revco/r/ CITjOFFO COLLINS COLORADO ATTEST By Cit C - 2 -
