OF THE CITY OF FORT COLLINS
AUTHORIZING THE ACCEPTANCE OF
A GIFT OF LAND FROM H W ROGERS
& ASSOCIATES AND THE ENTERING
INTO OF AN AGREEMENT WITH H W
ROGERS & ASSOCIATES CONCERNING
THE CONSTRUCTION AND FENCING OF
A PORTION OF THE POUDRE TRAIL
SYSTEM ON SAID LAND
WHEREAS, H W Rogers & Associates has made a gift of approximately
3 4 acres of land to the City of Fort Collins for utilizing in the Poudre
Trail System, and
WHEREAS, the afore-mentioned property adjoins the property presently
utilized by H W Rogers & Associates for mining and other industrial uses,
and
WHEREAS, in the considered opinion of the Council of the City of Fort
Collins, it is necessary and appropriate that the City undertake affirma-
tive measures to provide for the construction of a fence between the Poudre
Trail System and those properties used by H W Rogers & Associates for
mining and industrial purposes
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT
COLLINS
Section 1 That the gift of H W Rogers & Associates of approxi-
mately 3 4 acres of land, all as set forth in the attached Agreement, be,
and it hereby is, accepted with thanks and appreciation by the City of Fort
Collins
Section 2 That the Agreement attached hereto between the City of
Fort Collins and H W Rogers & Associates be, and it hereby is, in all
respects approved, and that the Mayor and City Clerk of the City of Fort
Collins be, and hereby are, authorized and directed to execute said Agree-
ment on behalf of the City
Passed and adopted at regular meeting of the City Council held this
5th day of December, A D 1978
