HomeMy WebLinkAbout1981-082-06/16/1981-ADOPTING THE REPORT OF THE DIRECTOR OF PUBLIC WORKS ON THE ESTIMATES, COSTS, AND ASSESSMENTS FOR THE RESOLUTION 81-82 OF THE COUNCIL OF THE CITY OF FORT COLLINS ADOPTING THE REPORT OF THE DIRECTOR OF PUBLIC WORDS ON ThE ESTIMATES, COSTS, AND ASSESSMENTS FOR THE SOUTH MASON STREET AND UTILITY IMPROVEMENT DISTRICT NO 75, APPROVING THE DETAILS AND SPECIFICATIONS FOR SUCH PROPOSED DISTRICT, DETERMINING THE AMOUNT OR PROPORTION OF THE TOTAL COST TO BE PAID BY A METHOD OTHER THAN ASSESSMENTS AGAINST PROPERTY IN THE DISTRICT, THE NUMBER OF INSTALLMENTS AND THE TIME WITHIN WHICH THE COSTS OF THE IMPROVEMENTS ASSESSED AGAINST PROPERTY IN THE DISTRICT WILL BE PAYABLE, THE RATE OF INTEREST TO BE CHARGED ON UNPAID INSTALLMENTS, THE PROPERTY TO BE ASSESSED FOR THE IMPROVEMENTS AND THE METHOD OF MAKING SUCH ASSESSMENTS WHEREAS, heretofore, the City Council , by resolution directed the Director of Public Works to prepare and present to the City Council the necessary information for the formation of the South Mason Street and Utility Improvenent District No 75, including the preparation of a map, plans, specifications, and estimate of costs of the improvements in said proposed district, and WHEREAS, the Director of Public Works has made his report and has presented the details and specifications for the proposed district NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS Section 1 That the report, plans, specifications, map, and estimate as presented by the Director of Public Works for said district be, and the same hereby are, accepted and approved Section 2 That the following amount or proportion of the total cost of such improvements shall be paid by the City at large and not by assess- ments against property in the district, to-wit Street Oversizing in the amount of $3,840 00 Section 3 That the property to be assessed for the improvements shall be as follows A South College Investments A tract of land situate in the northeast quarter of Section 35, Township 7 North, Range 69 West of the Sixth Principal Meridian, City of Fort Collins, County of Larimer, State of Colorado, being more particularly described as follows considering the east line of said northeast quarter as bearing Soutn 00*29100" East and with all bearings contained herein and relative there- to, beginning at the Northeast corner of said Section 35, and run thence along said east line South 00°29'00" East 1956 80 feet, thence North 89055'45" West 51 20 feet to the Northeast corner of Garth Commercial Plaza and the true point of begin- ning, thence along the North line of said Garth Commercial Plaza North 89°55'30" West 891 80 feet to the east right-of-way of the Colorado and Southern Railroad, thence along said right-of- way North 00°58'30" East 200 02 feet to the South line of RCD Plaza South Subdivision, thence along said South line South 89055'45" East 887 45 feet to the southeast corner of said RCD Plaza South Subdivision, thence South 00°05'00" East 143 70 feet, thence South 00°45'00" East 56 30 feet to the True Point of Beginning Containing 4 08 acres more or less B RCD Plaza South A tract of land situate in the northeast quarter of Section 35, Township 7 North, Range 69 West of the Sixth Principal Meridian, City of Fort Collins, County of Larimer, State of Colorado, being more particularly described as follows considering the east line of said northeast quarter as bearing South 00 29'00" East and with all bearings contained herein relative thereto Begin at the northeast corner of said Section 35 and run thence along said east line South 00°29'00" East 1956 80 feet, thence North 89°55'45" West 51 20 feet, thence North 00045100" West 56 30 feet, thence North 00°05'00" West 143 70 feet, to the true point of beginning, thence North 89°55'45" West 888 12 feet, thence North 01004100" East 200 feet, thence South 89055'45" East 884 11 feet, thence South 00°05'00" East 199 97 feet to the True Point of Beginning containing 4 07 acres more or less C Fuqua Property - Northern Parcel A tract of land situate in the Northeast 1/4 of Section 35, Township 7 North, Range 69 West of the Sixth P M , Larimer County, Colorado, which considering the East line of said Northeast 1/4 as bearing South 00*29' East and with all bearings contained herein relative thereto is contained within the boundary lines which begin at a point on the Westerly right-of- way line of Colorado State Highway No 1 which bears North 89049'40" West 88 20 feet and again South 00*05' East 30 00 feet and again South 45 11 ' East 70 60 feet and again South 00005' East 1276 90 feet from the Northeast corner of said Section 35 and run thence South 00005' East 100 00 feet along said Westerly right-of-way line, thence North 89 55'45" West 884 11 feet to a point on the Easterly right-of-way line of the Colorado and Southern Railroad, thence North 01 04' East 100 00 feet along said Easterly right-of-way line, thence South 89°55'45" East 882 10 feet to the Point of Beginning, containing 2 0273 acres more or less Combined southern and northern parcels contain 4 06 acres, more or less D Creger Plaza A tract of land situate in the Northeast 1/4 of Section 35,, Township 7 North, Range 69 West of the Sixth P M , City of Fort Collins, County of Larimer, State of Colorado, being more particularly described as follows Considering the east line of said Northeast 1/4 as bearing South 00*29' East, and with all bearings contained herein relative thereto Begin at the Northeast corner of said Section 35 and run thence along the North line of said Northeast 1/4 593 14 feet, thence South 01 '04' West 420 00 feet, thence North 89 49'40" West 300 00 feet, thence South 01 *04' West 300 00 feet to the True Point of Beginning further described as the Northwest corner of Lot 10 of Creger Plaza Subdivision, thence South 89049'40" East 319 72 feet, thence South 03°02 '05" West 5 38 feet, thence South 89042'05" East 549 88 feet, thence South 00005' East 330 09 feet, thence North 89055145" West 400 00 feet, thence South 00 05' East 300 00 feet, thence North 89°55'45" West 482 10 feet, thence North 01 *04' East 638 30 feet to the True Point of Beginning, containing 9 98 acres more or less -3- r' Section 4 That the assessments for the cost of installing the improvements in the district will be made as follows All street and utility improvement costs, except those to be paid by the City at large, shall be assessed upon all lots and lands abutting on the streets improved in proportion as the frontage of each lot or tract of land is to the frontage of all lots and lands so improved Section 5 That said assessments shall be payable in ten ( 10) equal annual installments with interest on the unpaid installments to equal the interest rates payable on bonds issued by said district The rate on interest charged on unpaid installments, shall , in no event exceed fifteen percent (15%) per annum Section 6 That the assessments shall be made in the following manner Upon the completion of the improvements and acceptance by the City Council , the Director of Finance shall prepare a statement showing the whole cost of improvements, together with incidental costs associated therewith and shall cause to be prepared an assessment roll which shall contain the names of the last known owners of the property to be assessed, a description of each property to be assessed, and the amount of the assessment of each property The City Clerk shall notify the owners of all property to be assessed specifying the whole cost of the im- provements and the proportion to be paid by the City The assessment roll shall be on file in the City Clerk's Office The City Council shall hear and determine any complaints or objections which may be made in wi iting by any of the owners of the property to be assessed Thereafter, an assessing ordinance shall be passed by the City Council assessing the cost of the improvements against the property to be assessed in the propor- tion finally determined Section 7 That all property owners within the district have waived the procedural requirements of notice and hearing on the establishment of said district pursuant to the provisions of Section 16-38 of the Code of the City of Fort Collins, and that on the 16th day of June, 1981 , at the hour of 6 30 P M , in the Council Chambers , City Hall , City of Fort Collins, Colorado, the Council of the City of Fort Collins will consider the ordering by ordinance of the proposed improvements Passed and adopted at a regular mert , of t e City Council held this 16th day of June, 1981 ti ATTEST ICity4er -4-
