OF THE COUNCIL OF THE CITY OF FORT COLLINS
AUTHORIZING THE CITY MANAGER TO ENTER INTO A
CONTRACT CONCERNING EXCAVATION WORK AT
THE MICHIGAN DITCH
WHEREAS, the City of Fort Collins finds it necessary to install eight
thousand feet (8,000' ) of pipe on the Agnes Creek extension of the Michigan
Ditch, and
WHEREAS, the installation of said pipe requires special heavy equip-
ment which the City of Fort Collins does not have, and
WHEREAS, the Department of Public Works considers the performance
of McCoy Construction Company to be superior to the performance of any
other contractors previously involved in excavation work on the Michigan
Ditch, and
WHEREAS, the location of the Michigan Ditch limits the construc-
tion season, and
WHEREAS, Section 2-60 (A)(1) of the Code of the City of Fort Collins
allows the Purchasing Agent to contract for services the availability of
which is so limited that the normal bid process cannot be used or will
result in substantial higher cost to the City", and
WHEREAS, the limited availability of excavation services with the
necessary heavy equipment and the brief construction season could result in
additional cost to the City if the normal bid process is used
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that the City Manager be, and he hereby is, authorized to enter
into a contract with McCoy Construction Company for excavation work
associated with the installation of eight thousand feet of pipe on the
Agnes Creek extension of the Michigan Ditch Furthermore, payments under
said contract shall not exceed Fifty Thousand Dollars ($50,000 )
Passed and adopted at a regular meeting of the City Council held this
7th day of July , 1981
