RESOLUTION 81-117
OF THE COUNCIL OF THE CITY OF FORT COLLINS
APPROVING THE EXECUTION OF AN AGREEMENT WITH
PINEVIEW, INC IN ANTICIPATION OF THE ACQUISITION
OF CERTAIN STORM DRAINAGE FACILITIES
WHEREAS, Pineview, Inc is the owner of certain property in the City
which it intends to develop, and
WHEREAS, said property is located within the boundaries of the McClel-
land-Mail Creek Storm Drainage Basin, and
WHEREAS, the City Council has approved and adopted the master plan for
the McClelland-Mail Creek Storm Drainage improvements in order to provide
for the efficient, proper and safely controlled drainage of storm and
surface water across the subject property and other portions of the City,
and
WHEREAS, the City Council has approved and adopted a permanent financ-
ing plan for storm drainage capital improvements to finance the land
acquisition, design, engineering and construction of storm drainage facil-
ities within said basin, and
WHEREAS, certain essential facilities of said storm drainage basin are
anticipated to be located within the confines of the proposed development,
and
WHEREAS, the City has determined that the lands upon which said
facilities are to be located should be acquired by the City and that a
mechanism should be established whereby Pineview, Inc may be appropriately
credited for its expenses in connection with any such storm drainage
improvements of a regional or basin-wide nature
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that the City Manager be, and he hereby is, authorized to execute
an agreement with Pineview, Inc whereby the City agrees to purchase
certain lands designated for detention pond purposes, the purchase price
for said property to be determined upon the basis of a mutually acceptable
appraisal , with said purchase to be accomplished no later than the date of
final plat approval for said development In addition, said agreement
shall provide that, prior to the commencement of installation of storm
drainage improvements, the City shall adopt a policy for allocating the
costs and expenses of such improvements based upon the reasonable benefit
to be obtained by the property, and by the City, and develop a method
whereby the developer may receive reimbursement, offset or credit for any
expenses associated with the installatin of said improvements in excess of
those prescribed by the City policy of cost allocation
Passed and adopted by the Council of the City of Fort Collins at a
