OF THE COUNCIL OF THE CITY OF FORT COLLINS
CONCERNING A MUTUAL NUCLEAR WEAPONS MORATORIUM
BETWEEN THE UNITED STATES AND THE SOVIET UNION
WHEREAS, on August 6, 1982, petitions were submitted to the City of
Fort Collins pursuant to Article XVII ( Initiative and Referendum) of the
Charter of the City of Fort Collins petitioning the Council to pass an
ordinance concerning a mutual nuclear weapons moratorium between the United
States and the Soviet Union or to submit the proposed ordinance to a
vote of the qualified electors, and
WHEREAS, the Clerk of the City of Fort Collins has certified that said
petitions contained the requisite number of signatures for said proposed
ordinance to be considered by the Council , and
WHEREAS, the Council has considered the legislative and administrative
nature of the proposed ordinance, and
WHEREAS, administrative actions are temporary in effect, concern daily
affairs and relate to executive or ministerial action, and
WHEREAS, ministerial actions have been defined as requiring compliance
with instructions without requiring the use of any discretion, judgment or
skill , and
WHEREAS, legislative action normally relates to subjects of a perma-
nent nature or issues that are general in character, and
WHEREAS, the legislative status of any proposed ordinance is not
determined by the form and title under which it is submitted, and
WHEREAS, the Council has considered the proposed ordinance in accor-
dance with the aforementioned characteristics of legislative and admini-
strative actions
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT
COLLINS as follows
Section 1 That the proposed ordinance calling for a mutual nuclear
weapons moratorium between the United States and the Soviet Union concerns
an action which is temporary in effect, concerns daily affairs and requires
the performance of an executive or ministerial act
Section 2 That the proposed ordinance is found and determined to be
administrative in nature and, therefore, not subject to the initiative
procedure as set forth in Article XVII of the Charter of the City of Fort
Collins
Section 3 That pursuant to the finding of the Council that the
proposed ordinance is administrative in nature and not subject to the
initiative procedure, no further action shall be taken concerning the
proposed ordinance
Passed and adopted at a regular meeting of the City Council held this
17th day of August, 1982
